ORDER OF PUBLICATION IN THE CIRCUIT COURT OF KANAWHA COUNTY, WEST VIRGINIA Civil Action #: 22-P-75 Judge:SALANGO CHARLES TYLER Plaintiffs, Vs. HEIRS OF MYRTLE CASTO WITT, and UNKNOWN HEIRS OF GUY D. PHILLIPS, and UNKNOWN HEIRS OF HOWARD E. PHILLIPS, and UNKNOWN HEIRS OF ERNEST D. PHILLIPS, and UNKNOWN HEIRS OF GOLDIE GRIZOTT, and UNKNOWN HEIRS OF ROY L. PHILLIPS, and OTHER UNKNOWN PARTIES, Defendants. The object of the above styled action is to quiet title and vest title in the real property, free and clear of all claims of the above as to that certain parcel of real estate being located in Poca District, Kanawha County, West Virginia and describe as all of a 1.49 Acres as shown as Parcel #3 as shown on that plat entitled, “Plat Showing Survey of Four Parcels, Parcel #1-2.23 Acres, Parcel #2-2.28 Acres, Parcel #3 =1.49 Acres, and Parcel #4 = 0.560 Acre, Fronting on Kanawha County Route 36, Situate in Poca District, Kanawha County, West Virginia,” as surveyed by Michael E. Mayes, P.E., dated September 22, 2001, having a scale of one inch equaling 50 feet and said plat of record in the Kanawha County Clerk’s Office in Deed Book 2513, at page 850. Being property, which was conveyed unto Charles Tyler and Gloria Tyler from Charles Midkiff and Mary Midkiff, by Deed dated August 2, 2002, which Deed is recorded in the Office of the Clerk of the County Commission of Kanawha County in Deed Book 2562, at page 619. Charles Tyler was conveyed all interest in said property by Deed dated September 13, 2012, by Gloria Tyler conveyed which Deed is of record in the aforesaid Clerk’s Office in Deed Book 2834, at page 220, being Parcel Two therein. Myrtle Casto acquired title in part to the property from her husband Okel Phillips who died on August 12, 1951 and left as his heirs at law, his wife Myrtle Phillips (now Myrtle Casto) and his children Guy D Phillips, Ernest Phillips, Mary Midkiff, Goldie G. Griscott, Bernardine Phillips and Howard E. Phillips and Roy L. Phillips, all as set forth in the aforesaid Clerk’s Office in Deed Book 1605, at page 356. And it appearing that the identity and whereabouts of some of the party Defendants is unknown or not determinable and there may be persons other than those named in the Complaint interested in the subject matter of this action, whose names and whereabouts are unknown to the Petitioner, it is ORDERED that the above named Respondents, together with any persons holding an interest in the above described property, serve upon L. Richard Dorsey, II, Plaintiff’s attorney, whose mailing address is P.O. Box 1083, Hurricane, West Virginia 25526, an answer or any defense to the Complaint filed in this action on or before, April, 8th, 2022, otherwise judgment by default may be taken against the Respondents, ay any time thereafter. A copy of this Complaint in this action can be obtained from the undersigned Clerk’s Office.
