Beaver, II, Unknown Persons/Owners, and Corey Miller, Sheriff of Mason County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Mason County, West Virginia, and is known as Civil Action No. CC-26-2022-C-8, and styled Appalachian Power Company vs. John M. Beaver, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate on West Virginia, Secondary Route 62/27, in Cooper District, Mason County, West Virginia, identified as Tax Map 227, Parcel 14, and recorded in the office of the Clerk of the County Commission of Mason County, West Virginia, in Deed Book 373, at page 508, and being more specifically bounded and described as follows: 26.165 ACRES BACK LETART LESS PITTSBURGH 8A COAL SEAM & COALBED METHANE Beginning at a point on the centerline of Route 62/27, said point a corner common to Bearnice Boster (B321 P391), William Brown (B293 P124) and William Brown (268 P523), from said point a power pole bears N27 50 W 67.69, said point also being the principle place of beginning of the parcel herein described: Thence leaving said road and W. Brown (B268 P523) and with the said W. Brown (B293 P124)-Boster line N61 00 44 E 526.19′ to a concrete monument found on the line common to Doris Martin (B285 P244); thence leaving said Boster and with the said W. Brown-Martin line S12 13 01 E 46.30 to a point on the West side of a fence corner tree; thence continuing with the said W. Brown-Martin line N80 55 07 E 480.69 to an iron pin set on the line common to the Central Coal Company (B126 P518); thence leaving said Martin and with the said W. Brown-Central Coal Company line then the W. Brown-County Commission of Mason County (B252 P271) line S 09 14 05 W 1788.07 to an iron pin set at a corner common to Dennis Kimes (B288 P419), from said iron pin set a 20 red oak bears N73 21 W 12.36′ , a 24″ red oak bears N49 20 W 5.92′ and the creek-drain intersection bears S 32 18 W 61.18′; thence leaving said County Commission of Mason County and with the said W. Brown-Kimes line N 49 19 52 W 1109.54′ to a point at a corner common to Kevin Brown (B305 P435) and said W. Brown (B268 P523), said point also on the centerline of said Route 62/27 and from said point an iron pin set Southwest 4.50′ from a corner post bears N 49 19 52 W 19.01′; thence leaving said K. Brown and Kimes and with the said W. Brown (B293 P124)-W. Brown (B268 P523) line and the centerline of said road the following eight bearings and distances: N44 37 30 E 283.02′ to a point; N38 01 04 E 57.01 to a point; N20 39 20 E 61.75′ to a point; N07 37 01 E 65.40′ to a point; N01 03 08 W 59.39′ to a point; N09 10 34 W 69.87 to a point; N13 56 59 W 45.30′ to a point; N14 57 37 W 222.47′ to the principle place of beginning, containing 26.165 acres, more or less. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Mason County Circuit Clerk’s office at 200 Sixth Street, Point Pleasant, West Virginia, 25550, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on April 18, 2022, at 1:20 p.m., in the Circuit Court of Mason County, West Virginia, located at 200 Sixth Street, Point Pleasant, West Virginia, 25550, before the Honorable Richard Tatterson. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
