ORDER OF PUBLICATION IN CIRCUIT COURT OF KANAWHA COUNTY, WEST VIRGINIA Civil Action #: 22-P-97 Judge: Bailey CHRISTOPHER HENRY TAMIKA HENRY Plaintiffs, Vs. BUELAH I. ADKINS, STANTON C. BAYS ROMEO M. BAYS, VAUGHN C. BAYS, EARL BAYS, JACK BAYS, PAMELA DAVIS, SHERRY BLAIR, BRIDGETTE SHAFFER, SHIRLEY SPEARS COLLINS,RAYMOND L. BAYS, MARY SUE BAYS, LORETTA ANN EDENS, and OTHER UNKNOWN HEIRS OF JACK D. BAYS, Defendants. The first object of the above styled action is to quiet title and vest title in the real property, free and clear of all claims of the above as to that certain parcel of real estate described all of Lots 12, 13, 14 and 15 of Block 141 of Booker Washington Park, as shown and designated upon a map or plat of the said Booker Washington Park, made by Clark & Krebs, C.E., which is duly of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Map Book 2, at page 103. The second objective of said action is if the action to quiet title and vest title in Lots 14 and 15 as described above is to obtain an easement across said Lots 14 and 15 for the benefit of and use by Lots 12 and 13 described above. Being the same properties conveyed unto Jack D. Bays, by Deed dated August 15, 1977, from Vaughn Clayton Bays and Ina Virginia Bays, recorded in the aforesaid Clerk’s Office in Deed Book 1840, at page 62. The aforesaid Jack D. Bays died intestate in Kanawha County, West Virginia on April 24, 1995, and pursuant to his Affidavit of heirs of record the aforesaid Clerk’s Office in Book 213, at page 411, the deceased was never married and had no children and his parents were deceased, therefore the following were listed as his heirs, Beulah I. Adkins, Stanton C. Bays, Romeo M. Bays, Vaughn C. Bays, Beverly B. Bays, and William A. Bays, Jr. The aforesaid Beverly B. Bays was said to have predeceased Jack D. Bays and left as his heirs Earl Bays, Jack Bays, Pamela Davis, Sherry Blair, Bridgette Shaffer, Shirley Spears Collins and Regina Bays. The aforesaid William A. Bays, Jr., was said to have predeceased Jack D. Bays and left as heirs Raymond L. Bays, Mary Sue Bays and Loretta Anne Edens. Beulah I. Adkins, died on March 10, 2002 and she left as heirs Arnold Adkins, Frances Kay Adkins, Novia D. Webb, Debra Horton, Trena F. Adkins, Vickie Lee Wells and Eugene V. Adkins. Romeo Bays died April 6, 1999, no probate records or heirs were found of record. The aforesaid Lots 12 and 13 Block 141 Booker Washington Park, were sold for taxes unto Chuckie D. Battey by Tax Deed dated August 23, 2013 of record in the aforesaid Clerk’s Office in Deed Book 2858, at page 718. The aforesaid Castile, LLC acquired title to the property by Tax Deed dated March 20, 2018, of record in the aforesaid Clerk’s Office in Deed Book 3001, at page 677. Then conveyed unto Christopher Henry and Tamika Henry by Quitclaim Deed from Chuckie D. Battey dated May 7, 2020, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 3059, at page 221. Further being the same property conveyed unto Christopher Henry and Tamika Henry, by Castile, LLC, a West Virginia Limited Liability Company, by Deed date September 8, 2020, of record in the aforesaid Clerk’s Office in Deed Book 3076, at page 927. The aforesaid Lots 14 and 15 Block 141 Booker Washington Park were sold for taxes to the State of West Virginia. And it appearing that the identity and whereabouts of some of the party Respondents is unknown or not determinable and there may be persons other than those named in the Complaint interested in the subject matter of this action, whose names and whereabouts are unknown to the Petitioner, it is ORDERED that the above named Respondents, together with any persons holding an interest in the above described property, serve upon L. Richard Dorsey, II, Petitioners attorney, whose mailing address is P.O. Box 1083, Hurricane, West Virginia 25526, an answer or any defense to the Complaint filed in this action on or before, April, 25, 2022, otherwise judgment by default may be taken against the Respondents, ay any time thereafter.
