TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 16, 2013, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 3972, at Page 292, Emisha L Reed did convey unto Douglas McElwee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Rushmore Loan Management Services, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on April 26, 2022 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 10 – Chas N District, Kanawha County, West Virginia, and more particularly described as follows: All of that certain lot or parcel of land, together with the appurtenances thereunto belonging, situate in Charleston District, Kanawha County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at an iron pin located in the southerly line of Oak Ridge Drive, said beginning point being also located, N 82 52′ W 1432.80 feet from a concrete monument in the southerly line of said Oak Ridge Drive, 20 feet from the center-line of the present pavement, at the point designated “C” on a map recorded with that certain deed bearing date the 10th day of April, 1953, between General Realty Company, a corporation, and R. H. Henson and Ella Henson, his wife, et als, recorded in the office of the Clerk of the County Court of Kanawha County, West Virginia, in Deed Book 1044 at page 166, said beginning point, being also located at the northwesterly corner of a parcel of land conveyed by that certain deed bearing date the 7th day of April; 1954, from General Realty Company, a corporation, to Floyd N Robertson and Christine M. Robertson, his wife, recorded in the aforesaid Clerk’s office in Deed Book 1086 at page 396; thence running with one line of said Robertson parcel, S 2 18′ W 110.00 feet to an iron pin, located at the common rear corner of the parcel of land hereby conveyed, the said Robertson parcel, and a parcel of land conveyed by that certain deed bearing date the 13th day of July, 1953, from General Realty Company, a corporation, to Alex Asseff, recorded in the aforesaid Clerk’s office in Deed Book 1054 at page 385, and another parcel conveyed by that certain deed bearing date the 13th day of July, 1953, from General Realty Company, a corporation, to the said Alex Asseff, recorded in the aforesaid Clerk’s office in Deed Book 1054 at page 389; thence running with One line of the latter Asseff parcel, N 87 42′ W 75.00 feet to an iron pin located at the common rear corner to the said Asseff parcel, the parcel hereby conveyed, and General Realty Company land; thence leaving said Asseff parcel and running N 2 21′ E 106.68 feet to an iron pin located in the southerly, line of Oak Ridge Drive; thence with the said southerly line of Oak Ridge Drive, with a curved line to the right, the chord of which bears N 88 33′ E 37. 50 feet to an iron pin; thence continuing with the said southerly line of Oak Ridge Drive, with a curved line to the right, the chords of which bears, S 89 01′ E 37. 50 feet to the place of beginning, containing one-hundred eighty-seven one thousandths (0.187) of an acre, as surveyed by the Field Engineering Company, Charleston, West Virginia, and shown on a map dated May 13, 1954, which is attached to Deed Book 1090, Page 316. LSOT: Deed Book 1373, Page 79, dated April 19, 1962, Office of the Clerk of the County Commission of Kanawha County, West Virginia. Thereafter, Russell Ellis died July 31, 1969, and Mary Ellis died January 30, 2013; see Will Book 853, Page 777. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1905 Oakridge Dr, Charleston, WV 25311. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and r certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
