NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE and Notice of the Beneficiary ervicer’s election to sell property is hereby given pursuant to and by virtue of the authority vested in the Trustee by that certain Deed of Trust dated February 4, 2006, executed by Daniel D. Burdette and Nicole L. Burdette (formerly known as Nicole L. Edens) to William W. Smith, Trustee, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3538, at Page 219, which Deed of Trust was assigned from C.K.C. Properties, LLC to First National Acceptance Company by Assignment dated August 16, 2011, of record in the Clerk’s Office in Assignment Book 233, at Page 840, and further assigned by First National Acceptance Company to Rose Land and Finance Corp. by Assignment dated February 3, 2015, of record in the Clerk’s Office in Assignment Book 247, at Page 16. Bailey & Slotnick, PLLC was appointed as Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated September 27, 2019, of record in the Clerk’s Office in Book 4385, at Page 752. The borrower defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on: TUESDAY, APRIL 12, 2022, AT 10:00 O’CLOCK A.M. All those certain tracts or parcels of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate on the Left Hand Fork of Kanawha Two Mile Creek, Union District, Kanawha County, West Virginia, being more particularly bounded and described as follows, to-wit: PARCEL ONE: BEGINNING at a 1/2 inch iron pin (set) in the westerly right of way line of West Virginia Secondary Route Number 221/8 (Also known as Woodward Drive), said point being located 5.50 degrees 45′ East from an old iron pin (found) by 2 inch pipe fence post at the most southerly corner of the “Young Family Cemetery”, and running thence from said beginning point with westerly right of way line of West Virginia Secondary Number 221/8 with a curved line to the left with on chord thereof South 38 degrees 46′ West, a chord distance of 100.00 feet to a h inch iron pin (set) at the most southerly corner of the 0.459 acre parcel herein described; thence leaving West Virginia Secondary Route Number 221/8 and running North 50 degrees 45′ West, 200.00 feet to an iron pin (set); thence running with a line being an extension of the southerly line of the “Young Family Cemetery”, South 50 degrees 45′ East, passing a 2 inch pipe fence post at the northwesterly corner of cemetery at 114.06 feet and continuing on in the same straight line in all a distance of 200.00 feet to the place of beginning: and being more particularly shown upon a map entitled, “Map Showing a 0.459 acre parcel of land being a part of a 17.50 acre tract of land located in Union District, Kanawha County, WV, presently owned by Erma G. Creasy to be conveyed to Michael Parrish and Cynthia M. Parrish”, dated July 19, 1990, and attached and made a part of that certain deed of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 2252, at page 152; PARCEL TWO: BEING a triangular portion of real estate containing .6 acres on Left Hand Fork, Kanawha Two Mile, Union District, Kanawha County, WV, and being more fully described in the said Clerk’s office in Deed Book 2318, at page 848, and adjoining Parcel One herein and listed on the Land Book of Union District for the year 1997 as follows: (Account Number 07522335), Parcel containing .6 Left hand Fork 2 Mile Creek TM 24, Parcel 9.4; and more particularly bounded and described as follows: Commencing on the N. side of WV Secondary Route 221/8, being the common corner to property owned by Michael L. and Cynthia M. Parrish, his wife, thence running 38.68 feet along the common division line, N. 59 degrees 45′ 00″ W. to a point on the common corner of the Parrish property, the Creasy property and the Young Family Cemetery; thence running N. 55 degrees 30′ E. to a point on the No. right of way of Secondary Route Number 221/8; thence running S. 77 degrees 05 56″ W. 78.07 feet to the place of beginning; And being the same property conveyed to Nicole L. Edens (now Nicole L. Burdette, married), and Daniel D. Burdette, from City National Bank of West Virginia, by deed dated January 28, 2002, and of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 2543, at page 600. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-2. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee by cashier’s check, cash or money order within thirty (30) days of the date of sale, with a minimum deposit of $6,000.00 payable to the Trustee by cashier’s check, cash or money order at the time and place of the sale.
