IN THE CIRCUIT COURT OF KANAWHA COUNTY, WEST VIRGINIA KANAWHA PUBLIC SERVICE DISTRICT, a public utility, Petitioner, vs. Mark and Sharon Anderson Respondents CIVIL ACTION 22-P-95 Honorable Kenneth D. Ballard, Circuit Judge ORDER OF PUBLICATION The object of the above-entitled action is a condemnation proceeding involving certain real property owned by Mark and Sharon Anderson, and the acquisition of a right of way and casement across a portion of that certain real property of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in deed book 2735 at page 34, tax map 27A parcel 82. And it appearing by affidavit filed in this action that the said Mark and Sharon Anderson’s whereabouts are unknown and that service of process has been unsuccessful. It is hereby ORDERED that the Mark and Sharon Anderson does appear and serve upon H. Wyatt Hanna, III, Petitioner’s attorney whose address is Post Office Box 8070, South Charleston, West Virginia 25303, an answer or other defense to the Condemnation Petition filed in this action on or before 30 days, otherwise judgement by default will be taken against them at any thereafter. A hearing for the purpose of appointing Condemnation Commissioners will be held before the Honorable Kenneth D. Ballard, Circuit Judge on April 28, 2022 at 10:30 am. You may appear at said hearing to protect your interests. A copy of said Condemnation Petition and Order granting the respondent, Kanawha Public Service District, a Right of Entry can be obtained from the undersigned Clerk at the Clerk’s office located in Kanawha in said county and state.
