Dallas Kayser, Trustee, Unknown Persons wners, and Corey Miller, Sheriff of Mason County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation ight of Entry has been filed in the Circuit Court of Mason County, West Virginia, and is known as Civil Action No. CC-26-2022-C-16, and styled Appalachian Power Company vs. Adam James Newberry, et al. Said Petition for Condemnation ight of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate in Cooper and Graham Districts, Mason County, West Virginia, identified as Tax Map 205, Parcels 27.2, 28, and 30, and recorded in the office of the Clerk of the County Commission of Mason County, West Virginia, in Deed Book 458, at page 447, and being more specifically bounded and described as follows: OT 26.08 ACRES OT 95 ACRES OT BEGINNING at a center of intersection of Mason County Secondary Roads Nos. 7 and 12; thence with the center of Secondary Road No. 12 the following courses and distances: S. 87 1/2DEGREES E. 23 3/4 poles, N. 71 3/4DEGREES E. 24 1/4 poles, S. 54DEGREES E. 28 poles, S. 56DEGREES E. 23 poles, S. 89 1/2 E. 22 1/2 poles, S. line of original 318 acre tract S. 54 3/4DEGREES E. 194 1/2 poles to a stone with pointers, Chestnut, Oak and Hickory; thence S. 20 W. 56 1/2 poles to a stone with Hickory and Dogwood pointers; thence N. 80DEGREES W. 161 1/2 poles to a stake in line of 74 acre tract; thence with Weaver line N. 5 1/2DEGREES E. 53 poles to a corner with Weaver on Easterly side of Robinson Creek; thence with another line of Weaver N. 51 1/2DEGREES W. passing under power lien leading to residence at 38 poles, in all 138 poles to a point in center of Mason Secondary Road No. 7; thence with center of said road N. 14DEGREES W. 23 1/2 poles to the beginning, containing 152 1/2 acres, more or less. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation ight of Entry will occur on May 20, 2022, at 1:00 p.m., in the Circuit Court of Mason County, West Virginia, located at 200 Sixth Street, Point Pleasant, West Virginia, 25550, before the Honorable Richard Craig Tatterson. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
