TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 8, 2004, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 3108, at Page 506, M Salim Ratnani did convey unto Arthur M. Standish, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated November 13, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on December 17, 2019 at 4:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Charleston South Annex Corp District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, located near Alpha Road, in the City of Charleston, West Virginia, more particularly known and designated as Lots Nos. 14 and 16 of Section Four, as shown on that certain map entitled, “Map Showing Whispering Woods, Inc., Section Four Situate on the Waters of Chappell Hollow And Cane Fork Of Davis Creek Loudon District, Kanawha County, WV,” made by Bowman Land Surveying Company, Inc., dated June, 1990 (the “Subdivision Map”), and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 45, at page 68, together with the non-exclusive right of way and easement over and across Whispering Woods Road for ingress and egress to and from Alpha Road and said lot and any common areas that may be subsequently developed in Whispering Woods Subdivision, as said Whispering Woods Road is shown on the plats of record for Sections One, Two and Three of Whispering Woods Subdivision in Map Book 38, at pages 72 – 73, Map Book 42, at page 49 and Map Book 43, at page 85, respectively, and as said Whispering Woods Roads is shown and designated on the Subdivision Map as the “40 R/W” which extends through Section Four and terminates at the cul-de-sac located at Lot Nos. 22, 23 and 24 of Section Four, as shown on the Subdivision Map. And being the same property conveyed to M. Salim Ratnani by deed dated December 23, 2003, from The M Nathalie Ratnani Living Trust, dated December 4, 1996, by M. Nathalie Ratnani, Trustee and Marie Nathalie Ratnani, a/k/a M. Nathalie Ratnani, individually, of record in the aforesaid Clerk’s Office in Deed Book 2593, at page 415. For the same consideration, the party of the first part further ASSIGNS, TRANSFERS and SETS OVER unto the party of the second part, his successors and assigns, one membership in Whispering Woods Homeowners Associations, Inc., together with all the rights, privileges and obligations of such membership. This conveyance is made subject to those certain covenants, restrictions, reservations and affirmative obligations, including but not limited to, utility easements and setback lines as set forth in the Declaration of Covenants, Conditions, Restrictions, Reservations and Easements for Section Four of Whispering Woods, a Subdivision Near the City of Charleston, Loudon Tax District, Kanawha County, West Virginia, dated October 15, 1990, and of record in said Clerk’s Office in Deed Book 2258, at page 569. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 238 Whispering Woods Road, Charleston, WV 25304. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
