NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated August 23, 2017, executed by Borrower, Mark Lee Ellis, to Marc J. Slotnick, Esq., the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4259, at Page 630. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 5206 Staunton Ave Se, Charleston, WV 25304. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 14, 2022, of record in the Clerk’s Office in Book 4578, Page 502. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 24th day of May, 2022 at 11:45 a.m. all of those certain parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Kanawha County, West Virginia, being the easterly five (5) feet of Lot Twenty-Three (23), all of Lots Twenty-Four (24) and Twenty-Five (25), and the westerly five (5) feet of Lot Twenty-Six (26), in Block One Hundred Sixty-Seven (167), as shown on a map entitled “Revised Map of Kanawha City”, which map is of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Photostatic Map Book 2, pages 148 and 149; which lots and parts of lots are adjoining and together form one parcel of real estate bounded as follows: BEGINNING at an iron pipe in the northeasterly line of Staunton Avenue at a point 170 feet distant in a southeasterly direction from the southeasterly line of 52nd Street, and which pipe is five feet distant in a northwesterly direction from the front common corner of Lots 23 and 24; thence in a line parallel to and five feet distant from the dividing line between Lots 23 and 24, No. 39DEGREES E. 120 feet to a point in the rear line of Lot 23 and in the southwesterly line of a 16-foot alley; thence with said alley, S. 51DEGREES E. 60 feet to a point in the rear line of Lot 26, five feet distant from the rear common corner of Lots 25 and 26; thence running through Lot 26, in a line parallel to and five feet distant from the dividing line between Lots 25 and 26, S. 39DEGREES W. 120 feet to an iron pipe in the northeasterly line of Staunton Avenue; thence with Staunton Avenue, N. 51DEGREES W. 60 feet to the place of beginning; And being the same property acquired by Francis B. Eberhart by deed dated January 19, 1989 from Nancy S. Hill of record in the aforesaid Cleric`s office in Deed Book 2218, at page 221. Said Francis B. Eberhart died testate on February 23, 1996 and devised the subject property to James Francis Eberhart, by will dated February 8, 1985 and recorded in the aforesaid Clerk`s office in Will Book 593, at Page 183. This conveyance is made subject to the restrictive covenants and reserved rights and privileges as set forth in that certain deed from Kanawha City Company to Aubrey W. Love, dated July 18, 1938, of record in the said Clerk`s office in Deed Book 465 at page 31, to which deed reference is here made for a further and fuller recital thereof. Being the same property conveyed to Mark Lee Ellis by the Deed dated August 22, 2017 and recorded in Deed Book 2980 at Page 569 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
