NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE and Notice of the Beneficiary/Servicer’s election to sell property is hereby given pursuant to and by virtue of the authority vested in the Trustee by that certain Deed of Trust dated May 17, 2017, executed by Whitney N. Louden and William E. Louden, Jr. to Kenneth Price, Trustee, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4242, at Page 247. Bailey & Slotnick, PLLC was appointed as Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 15, 2019, of record in the Clerk’s Office in Book 4388, at Page 806. The borrower defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on: THURSDAY, DECEMBER 12, 2019, AT 10:00 A.M. All that certain lot, tract or parcel of land, together with the improvements thereon thereunto belonging, situate in Big Sandy District, Kanawha County West Virginia, and being more particularly described as follows: Lot (15) of Section One of Harper Estates, as shown upon a map entitled, “Plat Showing Section One, Phase II, Harpers Estates On the Waters of Big Sandy Creek, A Tributary of Elk River, Big Sandy District, County, West Virginia”, dated February 23, 1988, and made by William R. Gunnoe, L.L.S., which map is of record in the Office of the County Commission of Kanawha County, West Virginia, in Photostatic Map Book 43, at page 62. Together with the right to use in common with other owners of Lots in Section One of Harper Estates, for the purpose of ingress and egress to and from said property hereby conveyed: (1) the forty (40) foot road, including the bridge traversing Big Sandy Creek from West Virginia Secondary Route 59, and (2) all lanes, roads, and drives which shall hereafter be included in additional Sections of said Harpers Estates as shown upon maps to be hereafter recorded in aforesaid Clerk’s Office and which shall be duly annexed to Section One of Harper Estates by Harper Association, Inc., a corporation. Subject to those certain utility easements recorded in the aforesaid Clerk’s Deed Book 1981, at page 386; Deed Book 2061, at page 400; Deed Book 2095, at page 697; Deed Book 2185, at page 422; Deed Book 2210, at Page 906; Deed Book 2224, at page 849; Deed Book 2231, at Page 290. Being the same property conveyed unto Whitney Haas, by Federal Home Loan Mortgage Corporation, by its Attorney-in-Fact, Samuel l. White, P.C., by deed dated August 15, 2012, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2831, at page 583; and also being the same property conveyed by Whitney N. Louden (f/k/a Whitney Haas), to Whitney N. Louden and William E. Louden, Jr., husband and wife, by deed dated June 21, 2016, and recorded in the aforesaid Clerk’s Office in Deed Book 2943, at page 890. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-2. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee by cashier’s check, cash or money order within thirty (30) days of the date of sale, with a minimum deposit of $20,000.00 payable to the Trustee by cashier’s check, cash or money order at the time and place of the sale.
