TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 23, 2008, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 3578, at Page 119, James E Cooper and Amy L Cooper and Leslie L Putillion, Jr did convey unto Arthur M Standish, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on June 7, 2022 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 15 – Elk District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Pinch, Elk District, Kanawha County, West Virginia, and being all of Lot A and a triangular-shaped parcel adjoining said Lot A, of the re-subdivision of part of a 0.837 acre parcel and a 1.695 acre parcel of the Charles E. Pauley property, and being more particularly bounded and described as follows: Beginning at the common front corners of Lots A and B of the Charles E. Pauley property located in the south line of Elm Street (also known as West Virginia Secondary Route No. 471/87); thence following said south line of Elm Street, N. 76 07′ 03″ W. 128.74 feet to an iron pin sent in the front line of a 1.695 acre tract; thence leaving Elm Street and running through the said 1.695 acre parcel, N. 21 09′ E. 131.60 feet to an old iron pin to property heretofore conveyed to American Classic Homes of Charleston, Inc.; thence following the the rear lot line of said Lot A, S. 74 00′ E. 90.30 feet to an old iron pin set at the rear common corner of Lots A and B; thence following the common division line of said Lots A and B, S. 4 08′ W. 129.06 feet to the place of beginning; all as shown upon a map prepared by Field Engineering Co., Inc., dated November 22, 1986, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2146, at Page 322. And being the same property conveyed to James E. Cooper and Amy L. Cooper, by deed dated November 3, 2007, from Robert A. Flanagan and Tamara S. Flanagan, husband and wife, to be recorded in the aforesaid Clerk’s Office contemporaneously herewith. This conveyance is made subject to the following restrictions, covenants and conditions: (1) The property hereby conveyed shall be used for residential purpose only and not more than one permanent single family dwelling shall be erected upon any one lot. (2) No temporary structures, trailers, or modular homes shall be erected upon any lot, with the exception of storage buildings and detached garages. (3) No dwelling shall be erected upon any lot which as an appraised value of less than Twenty-five Thousand Dollars ($25,000.00) based upon values in effect at the time of the recording of this conveyance. This conveyance is made subject to two utility easements, each ten feet in width, one of which runs along the front lot line of the property hereby conveyed and the other along the rear lot line of said property, both as shown upon the map above referred to. The parties of the first part herein GRANT and CONVEY to the parties of the second part, their successors and assigns, the right to use any and all rights of ways extending from the property hereby conveyed to the public roads as a means of ingress and egress. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 109 Elm St, Pinch, WV 25156. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and r certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
