Wheeler and Suzann Wheeler did convey unto Richard A. Pill and David D. Pill, Trustees, certain real property described in said deed of trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustees having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on Monday, June 27, 2022 at 5:46 PM the following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Loudon District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Loudon District, Kanawha County, West Virginia, as shown upon a map made by Carl Kinder, Surveyor, dated June 22, 1963 and entitled, “Map Showing Property Conveyed to Donald F. Cantrell and Marilyn F. Cantrell, Dry Branch of Davis Creek, Loudon District, Kanawha County, W. Va.”, said property is more particularly described as follows: BEGINNING at a stake in the easterly side of a dirt road near a large Poplar Tree, said stake being a corner to the Millie Hall property; thence with the easterly side of said dirt road S. 5 degrees 45′ W, 56.15 feet, more or less, to a stake; thence crossing said dirt road and up the hill S. 80 degrees 17′ W, 139.41 feet more or less to a stake, said stake being a point in the Everett Mille property line; thence with the said Miller property line the following courses and distances; N. 7 degrees 36′ E, 106.85′ (+) to a stake; N. 34 degrees 03 E, 114.90 feet (+) to a stake; 589 degrees 10′ E, 92.00 feet (+) to a stake; S 40 degrees 35′ E., 110.25 feet (+) to a stake located 15 feet westerly from the centerline of W. Va. Route No. 14; thence S. 69 degrees 40′ W, 105.72 feet more or less to the place of beginning and containing 28,766 square feet or 0.660 acres more or less. Said property is conveyed upon and subject to those certain covenants and restrictions recited and contained in the aforesaid Deed from J. W. Board and Ruby Ona Board, his wife, to Glen G. Hill and Jessie Hill, his wife, dated September 17, 1946 and recorded in aforesaid Clerk’s Office in Deed Book 761, Page 353, which shall constitute covenants running with the land hereby conveyed. And for the consideration aforesaid, the said parties of the first part further grant and convey unto the said parties of the second part, subject to the reservation hereinafter contained, a certain right-of-way as shown on the map of record in the aforesaid Clerk’s Office, and being more particularly described as a dirt right-of-way allowing ingress and egress to State Route #14. The parties of the first part do further grant and convey that certain pertinent easement and r right of way described in an agreement dated February 19, 1965, and recorded in the aforesaid Clerk’s Office in Deed Book 1431, Page 524. Subject to that certain right of way and easement for a septic systems conveyed unto Phyllis Ann (Miller) Foltz by right of way and easement dated October 29, 1985, and recorded in the aforesaid Clerk’s Office in Deed Book 2107, Page 709. At the time of the execution of the deed of trust, this property was reported to have a mailing address of Route 8 Box 415, South Charleston, WV 25309. AND BEING the same real estate which was conveyed to Randolph S. Wheeler and Suzann Wheeler by deed dated May 24, 2001, from Donald A. Marcellus and Lisa Marcellus, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2526, at page 678. The above described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
