Bankruptcy Case No. 14-bk-20017 Chapter 11 NOTICE OF HEARING ON CLAIMS ADMINISTRATOR’S MOTION FOR AN ORDER CLARIFYING THE PROCEDURE FOR DISPOSITION OF CERTAIN UNCASHED GENERAL CLAIMS AND SPILL CLAIMS CHECKS PLEASE TAKE NOTICE that, Robert L. Johns, General Claims and Spill Claims Administrator (“Administrator”) for the above captioned Debtor (the “Debtor), pursuant to Article XII of the Confirmed Plan Docket # 874 (the “Plan”) and after approval by the Spill Claims Oversight Committee, has filed a Motion for an Order Clarifying the Procedure for Disposition of $4,532.32 in Uncashed General Claims checks and $45,534.06 in Uncashed Spill Claims checks (the “Motion”). NOTICE IS FURTHER GIVEN THAT, the Motion requests Court Approval for the Administrator to: (i) pay twelve untimely check re-issuance requests received as of the date of this Notice in the total amount of $3,247.79; (ii) pay the Administrator’s costs and expenses in the amount of $14,681.00; and (iii) pay any remaining balances in the General and Spill Claims Funds to the West Virginia Department of Environmental Protection (“WVDEP”) (as partial reimbursement for Etowah River Terminal Clean-up costs paid by the WVDEP). The proposed payments will avoid any requirements to make further de minimus payments to General and Spill Claims Claimants. PLEASE TAKE FURTHER NOTICE THAT OBJECTIONS to the Administrator’s Motion must (a) be in writing and filed with the Clerk of the Court at Robert C. Byrd U.S. Courthouse, 300 Virginia Street, East, Room 200, Charleston, West Virginia 25301, on or before the hearing set out below; (b) comply with the Federal Rules of Bankruptcy Procedure and the Local Bankruptcy Rules; (c) set forth the name of the objector adn the Claim Number and the amount of its Class 3 General Claim or Class 5 Spill Claim previously filed as a Proof of Claim in this matter. HEARING. A hearing on the Motion will be held at 3:30 p.m., on Wednesday, December 18, 2019, in the United States Bankruptcy Court for the Southern District of West Virginia, 300 Virginia Street, East, 5th Floor, Charleston, West Virginia.
