NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated October 4, 2013, executed by Borrower(s), Dustin R Randolph, to Drew Patton, the Trustee of record in the office of the Clerk of the County Commission of Roane County, West Virginia, in Book 319, at Page 37. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 108 Jarvis Street, Spencer, WV 25276. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 27, 2022, of record in the Clerk’s Office in Book 370, Page 304. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Roane County, in Spencer, West Virginia, on the following date: 19th day of July, 2022 at 1:00 p.m. Being Lot A-16 in the East Meadows Subdivision, No. 1, Section “B”, the plat of which Subdivision is of record in the Office of the Clerk of the County Commission of Roane County, West Virginia, in Plat Book 3, at page 136, lying and being in Spencer Corporation, Roane County, West Virginia, bounded and described as follows: BEGINNING at a ONE-HALF inch iron rod set at the intersection of Jarvis Street and Craddock Drive; thence with Craddock Drive, S 4-34-40 E 125.64 feet to a ONE-HALF inch iron rod set, corner to Lot A-15; thence with Lot A-15 and leaving Craddock Drive, S 71-14 W 291.76 feet to a 2 inch iron pipe found, corner to Lot A-17 and Jarvis Street; thence with Jarvis Street, with a curve to the left a Delta Angle of 64 deg. 33′-44″ and Radius of 35` and Chord Bearing and Distance of N 73-45 E. 37.39 feet to a point; thence, with a curve to the right a Delta Angle of 34 deg. 33′-40″ and Radius of 50` and Chord Bearing and Distance of N 58-45 E 29.71 feet to a point; thence N 76-02 E 23 feet to the place of beginning, containing 0.54 acres, more or less, and more fully shown on a map or plat of recorded in the Office of the Clerk of the County Commission of Roane County, West Virginia, in Deed Book 321, at page 349. This conveyance is expressly made subject to each and all of the restrictive covenants, exceptions, easements and conditions contained and written on the above referred to plat, each of which covenants, exceptions, easements and conditions are made part hereof to the same extent as if fully written herein. This conveyance is further made subject to all the exceptions, conditions, covenants, restrictions and easements contained in that certain Agreement dated the 19th day of June, 1980, by and between Joe A. Craddock and others and the City of Spencer and the City of Spencer Sanitary Board, which agreement is of record in said Clerk`s Office, in Deed Book No. 279, at Page 225. BEING the same property granted and conveyed unto Dustin R. Randolph by Eugene Benear and Mary L. Benear, husband and wife, by Deed dated October 4, 2013, and of record in the Office of the Clerk of the County Commission of Roane County, West Virginia, in Deed Book 501, at page 483. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
