IN THE CIRCUIT COURT OF KANAWHA COUNTY, WEST VIRGINIA CIVIL ACTION NO. 22-C-564 Judge Ballard GARLAND DALE THAXTON and KELLEY THAXTON, his wife, Plaintiffs, v. JUSTIN HARMON, MARY C. HARMON, TODD L. CRAIN and KARLINDA MENTO, Defendants. ORDER OF PUBLICATION The object of the above entitled action is a Partition Suit with respect to that certain real property situate on Tuppers Creek of Poca River, in Union District, Kanawha County, West Virginia, as described in that certain deed to Oather Good and Nora Good, his wife, recorded in the Office of the County Clerk of Kanawha County, West Virginia, in Deed Book 1294 at page 72, wherein the Petitioners are seeking to acquire the interests of the Defendants in said real property. And it appearing by an Affidavit filed in this action that the whereabouts of the Defendant Mary C. Harmon are unknown and that each of the Defendants have thirty (30) days from the date of the first publication of this notice to appear or make a formal response to the petition. In the event that you fail to so defend and appear that action by default may be taken against you with respect to your interest in said property. It is Ordered that the Defendants do serve upon Walton S. Shepherd, III, Petitioners’ attorney, whose address is P. O. Box 13249, Sissonville, West Virginia 25360, an answer or other defense to the Petition Suit sought in this action on or before thirty (30) days from the date of the first publication of this notice, that being the 23rd day of August, 2022, otherwise judgement by default will be taken against the Defendant at any time thereafter.
