NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated May 18, 2016, executed by Borrower, Christopher B. Eckles, to Dru A Shope, the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2617, at Page 179. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2102 Jefferson Ave, Huntington, WV 25704. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated April 4, 2022, of record in the Clerk’s Office in Book 411, Page 158. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: 23rd day of August, 2022 at 10:15 a.m. TRACT ONE: All that certain lot, piece or parcel of ground situated in the City of Huntington, Cabell County, West Virginia, known and designated on a map of MEREDITH & NEEL FAIRHOME ADDITION to Central City, which map was recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, on the 14th day of November, 1907, as LOT NUMBER TWENTY-EIGHT (28), of BLOCK NUMBER ONE HUNDRED SEVENTY-FOUR (174). TRACT TWO: All that certain lot, piece or parcel of land situated in the City of Huntington, in that part formerly known as Central City, Cabell County, West Virginia, known and designated on the Map of Meredith & Neel`s Fair Home Addition to Central City filed in the Office of the Clerk of the County Court of Cabell County on 14 November 1907, which is supplementary to the Map of said Central City made by George McKendree, Engineer, and filed in the said Clerk`s Office of 3 October 1891, and thereon designated as LOT NUMBER TWENTY-SEVEN (27) in Block NUMBER ONE HUNDRED SEVENTY FOUR (174), being a lot fronting 30 feet on the North side of Jefferson Avenue, being 30 feet westerly from 21st Street, West, and extending northwardly at right angles, of equal width, 92 ONE-HALF feet to a 15 foot public alley running parallel with said Jefferson Avenue; TOGETHER WITH the right and privilege to use a walkway on Lot No. 28, in Block 174, as a driveway for automobiles, as provided for in that certain deed dated on 1 September 1923 and recorded in the aforesaid Clerk`s Office in Deed Book No. 209 at Page 339. SUBJECT, HOWEVER, to the right and privileges to the present and all future owners of said Lot No. 28, to use the walkway now located on the lot herein conveyed, for the purpose of ingress and egress as a driveway for the aforesaid automobiles. LSOT: Deed Book 1132, Page 699, dated November 29, 2004, and Deed Book 1194, Page 107, dated October 21, 2008, Office of the Clerk of the County Commission of Cabell County, West Virginia. Thereafter, Elizabeth Louise H. Perdue died May 31, 2015. See Will Book 214, Page 425. Being the same property conveyed to Christopher B. Eckles by the Deed dated May 5, 2022 and recorded in Deed Book 1348 at Page 316 in the Office of the Clerk of the County Commission of Cabell County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
