LEGAL NOTICE OF TRUSTEE’S SALE NOTICE is hereby given by the undersigned Trustee, by virtue the authority vested in her by that certain Deed of Trust dated the 7th day of August, 2020, executed by JIMMY L. SHAFFER and ARLENE G. CARTE, to LISA M. MOYE, Trustee, to secure CHERYL A. PATRICK and RICHARD L. PATRICK, said Deed of Trust being duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 4441, at page 288, default occurring under the terms of provisions of said Deed of Trust, and the provisions in said Deed of Trust concerning acceleration having been complied with by the beneficiaries and holders of the Note secured by said Deed of Trust, the undersigned Trustee will offer for sale at public auction on the 23rd day of September, 2022 at 2:00 p.m., at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, located at 407 Virginia Street, East, all those certain lots, tracts, or parcels of lands, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston (West), Kanawha County, West Virginia, and being part of Lot Number One (1) of Block No. 25 of Glenwood Addition to the City of Charleston, as laid out in lots, streets, and alleys upon the map of same made by W.C. Moler, C.E., recorded in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 1 at page 8, and being more particularly bounded and described as follows: Beginning east the southeast corner of said lot at the intersection of the northern line of Sixth Street with the western line of the lot conveyed by H. M. Mariani to Augusta V. Shannon by Deed recorded in the aforesaid Clerk’s Office in Deed Book 123, at page 257; thence with said line of South Street in a western direction 50 feet to a stake; thence in a northern direction 80 feet, more or less, in a line parallel to Park Avenue to and Alley; thence in a line of said alley in a southeastern direction 50 feet, more or less, to a stake at the corner of the lot conveyed by H. M. Mariani, as above stated; thence with a line of same 57 feet, more or less, to the beginning. AND BEING THE SAME property conveyed unto Jimmy L. Shaffer and Arlene G. Carte, by Cheryl A. Patrick and Richard L. Patrick, by Deed dated the 7th day of August, 2020, and duly of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 3073 at page 343. TERMS OF SALE: Said property will be sold for cash in hand on the day of the sale or upon such other terms as may be acceptable to the Trustee on the date of sale. The sale will be made subject to all unpaid real property taxes and special assessments, if any, and also subject to any exceptions, reservations, restrictions, covenants, conditions, agreements, and easements as found in the chain of title which affect any part of the property aforesaid, specifically including any which may be incorporated by reference in the aforesaid deed, or which are visible upon the ground. The sale will be further subject to all prior liens and encumbrances. The purchaser at the sale will be responsible for the payment of all real estate taxes, the recording costs for the deed to the property, and the tax on the privilege of transferring real estate (the cost of the tax stamps to be affixed to the deed). The party secured by said Deed of Trust reserves the right to purchase the property at such sale. The aforesaid property will be sold in its current “AS IS” condition. The aforesaid Trustee does not warrant title or fitness to said property and shall be under no duty to cause any existing tenant or person occupying the aforesaid property to vacate said property. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for the sale or by posting a notice of the same at the location of the sale. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell the aforesaid property as Trustee. INFORMATION REGARDING FEDERAL TAX LIENS: In the event there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under applicable law, whichever is longer.
