TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 9, 2002, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 2920, at Page 288, Stephen G Callis did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by US Bank Trust National Association, Not In Its Individual Capacity But Solely As Owner Trustee For VRMTG Asset Trust to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on September 6, 2022 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 15 – Elk District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Elk District, Kanawha County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a point at the northeasterly corner of the 2.3 acre tract or property of L. Fred Pauley, said point being a common corner of L. Fred Pauley and Lot No. 11 of the Gorver Conner Addition, and in the southerly line of property formerly owned by Carl Wiersteiner; thence with the boundary line between L. Fred Pauley and Carl Wiersteiner, S. 40 42′ 00″ W., 52.289 feet to a point, said point being the corner of L. Fred Pauley and the northeasterly corner of the property herein conveyed from said 2.3 acre tract; thence leaving the line of Carl Wiersteiner and with the line of the L. Fred Pauley and the property herein conveyed, S. 68 06′ 21″ E., 147.883 feet to a point; thence S. 57 56′ 21″ E. 129.305 feet to a point, said point being the southeasterly corner of the property herein conveyed; thence S. 31 11′ 57″ W., 91.00 feet to a point, said point being the southwesterly corner of the property herein conveyed; thence N. 58 48′ 03″ W., 287.782 feet to a point; said point being northwesterly corner of the property herein conveyed and the southerly line of Carl Wiersteiner; thence with the line of the property herein conveyed and Carl Wiersteiner; N. 40 42′ 00″ E. 70.00 feet to the place of beginning and containing 27,768 square feet or 0.545 of an acre, more or less, as shown upon a map entitled, “Surveyed For Jerry McIntosh”, made by Converse and Associates, Engineers and Surveyors, dated October 31, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1713, at page 308-A; And being the same real estate conveyed unto Stephen G Callis, by Dianna Sue Callis, by Deed dated December 9th, 2002 and to be recorded in the aforesaid Clerk’s Office simultaneously herewith as part of this transaction. It is the intention of this conveyance that the westerly line of the real estate herein conveyed is 2-ONE-HALF inches west of the westerly edge of the porch. And for the consideration aforesaid, the parties of the first part do hereby further GRANT and CONVEY unto the parties of the second part, as an appurtenance to the real estate herein conveyed, as easement and right of way for the purpose of ingress and egress across the southern end of the herein described real estate, reserved by J. Fred Pauley and Pauline Pauley, his wife, to the 30-foot right of way known as Beacon Terrace, to be used in common with J. Fred Pauley and Pauline Pauley, his wife, and their successors in title, subject to the reservation of the right to alter or change the right of way but in a constructive manner, to be left as good or better as existing at the time of conveyance. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1 Pauley Heights, Charleston, WV 25302. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and r certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
