PUBLIC NOTICE RECEIPT OF VOLUNTARY REMEDIATION APPLICATION PUBLIC NOTICE NO.: VRP #22006 NEWSPAPER: The Herald-Dispatch PUBLIC NOTICE DATE: August 4, 2022 Cabell County Board of Education has submitted an application to the West Virginia Department of Environmental Protection (WVDEP) to participate in a voluntary environmental cleanup at The Former Barboursville Brickyard under the Voluntary Remediation and Redevelopment Act. The site is located at Peyton Street, Barboursville, Cabell County, West Virginia, and is approximately 19.82 acres in size. The site was utilized as a brick manufacturing facility beginning in the early 1900s until the facility ceased manufacturing operations in 1979. Previous assessments (2003) have identified contamination at the site resulting from the brick manufacturing process and former underground storage tanks (USTs) which held fuel for use at the facility. In the fall of 2008, the Village of Barboursville (The Village) enrolled the site in the Voluntary Remediation Program (VRP) to allow redevelopment of the site. In March 2010, under the West Virginia Voluntary Remediation and Redevelopment Act (VRRA) and VRP, a Land Use Covenant (LUC) was established for the site. Under the LUC, certain restrictions for future development were placed on the site. Those restrictions included the use of groundwater extracted from the site, vapor barrier requirements for future buildings onsite, limitations on excavation onsite, and the prohibition of use of the site for residential purposes as defined by WV Code 22-22-2(bb). The Cabell County Board of Education (CBOE) purchased the site from The Village in August 2021. The site has now been re-entered into the VRP with intentions of remediating the site to residential standards and removing restrictions from the existing LUC for redevelopment and construction of a new school. The Office of Environmental Remediation (OER) at the WVDEP has negotiated a Voluntary Remediation Agreement with the applicant to address environmental conditions associated with the site. The agreement includes provisions for assessing potential environmental contaminants; evaluating human health and ecological risks; establishing remediation standards; and, performing any cleanup necessary to meet the standards. At project conclusion, the applicant will submit a Final Report, documenting that all work is complete.
