Lester aka Wooline Whitenack, State of West Virginia, Unknown Persons wners, and Martin West, Sheriff of McDowell County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation ight of Entry has been filed in the Circuit Court of McDowell County, West Virginia, and is known as Civil Action No. CC-27-2022-C-33, and styled Appalachian Power Company vs. Bobby Ray Muncy Unknown Heirs, et al. Said Petition for Condemnation ight of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate, lying, and being on Dry Fork River, about two and one-half miles above Iaeger, Sandy River District, McDowell County, West Virginia, identified as Tax Map 205, Parcel 46, and recorded in the office of the Clerk of the County Commission of McDowell County, West Virginia, in Deed Book 267, at page 640, and being more specifically bounded and described as follows: ISLAND 4 AC IN DRY FORK All that certain parcel of land which lies between the eastern right of way line of West Virginia Highway No. 80 (being the Iaeger-Bradshaw Road) and the western right of way line of the Norfolk and Western Railway Company Dry Fork line, which was excepted and reserved to the party of the first part hereto in a certain deed to the part of the second part, dated December 7, 1951, of record in the Office of the Clerk of the County Court of McDowell County, West Virginia, in Deed Book No. 198, Page 336. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation ight of Entry may be obtained from the McDowell County Circuit Clerk’s office at 90 Wyoming Street, Suite 201, Welch, West Virginia, 24801, for the purposes of appearing and defending. The Petition for Condemnation ight of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation ight of Entry will occur on September 29, 2022, at 10:30 a.m., in the Circuit Court of McDowell County, West Virginia, located at 90 Wyoming Street, Suite 201, Welch, West Virginia, 24801, before the Honorable Rudolph Murensky. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
