IN THE CIRCUIT COURT OF PUTNAM COUNTY, WEST VIRGINIA In the matter of: THE PETITION OF KYLE CHRISTOPHER EVERSOLE and ALEXA JOY EVERSOLE FOR THE ADOPTION OF LYLA PAIGE BATY AND EVELYN MARIE BATY, UNEMANCIPATED MINORS ADOPTION ACTION NO: 22-A-35 TO THE HONORABLE JUDGE OF SAID COURT: Your petitioners, Kyle Christopher Eversole and Alexa Joy Eversole, respectfully represent unto this Court as follows: 1. Your petitioners reside 241 Riverpoint Drive Redhouse, WV 25168. Your petitioners are citizens of the United States and of the State of West Virginia, and resident of the County of Putnam. 2. Your petitioners, Kyle Christopher Eversole DOB: 5-13-1999 and Alexa Joy Eversole DOB: 7-23-1999, are more than 15 years older than minors Lyla Paige Baty and Evelyn Marie Baty, DOB: 5-16-2017. 3. Petitioners are married and have a minor child who is a half-sibling to the minor children, Lyla Paige Baty and Evelyn Marie Baty who were born in Ann Arbor Michigan in Washtenaw County. 4. The minor children reside with Petitioners in Putnam County, WV for more than six (6) months prior to filing this petition and continues to reside with petitioners subsequent to the petition. 5. Petitioners present the facts and circumstances of the minor child as meeting the requirements and standards of W.Va. Code 48-22-306, alleging conduct by the biological father presumptively constituting abandonment of the minor child, wherein, pursuant to subsection (a) “Abandonment of a child over the age of six month shall be presumed when the birth parent: (1) Fails to financially support the child within the means of the birth parent; and (2) fails to visit or otherwise communicate with the child when he or she knows where the child resides, is physically and financially able to do so and is not prevented from doing so by the person or authorized agency having the care or custody of the child: Provided, that such failure to act continues uninterrupted for a period of six months immediately preceding the filing of the adoption petition.” 6. Petitioners are more than fifteen years older than the adoptee sought to be adopted. 7. Adoptees are unemancipated, and do not possess any real property or assets in possession of the adoptee relevant to the adoption proceedings. 8. The adoptees are NOT of American Indian descent; 9. Petitioner Kyle Christopher Eversole desires to legally adopt such adoptees, and it is his desire and intention, should the prayer of this petition for adoption be granted, that such adoptee’s legal names, SHALL BE CHANGED to Lyla Paige Eversole and Evelyn Marie Eversole. 10. Your petitioners believe that the best interests of such adoptees would be promoted by the granting of this petition. WHEREFORE, your petitioners pray that this petition be ordered filed with the Clerk of this Court and that a day be appointed for a hearing upon this petition; that this Court, in the event such is deemed advisable, refer this matter for discreet inquiry as to the desirability of this adoption being approved by this Court; that the name of such adoptees SHALL be changed to Lyla Paige Eversole and Evelyn Marie Eversole, that this Court enter all necessary orders and decrees to permit, authorize and effect the adoption of such adoptee by your petitioner; that this Court order and decree the adoption of such adoptee by your petitioner and that this Court grant unto your petitioner such other further and general relief as may be deemed necessary.
