TOWN OF CEDAR GROVE, a municipal utility, Kanawha County, Defendant. CASE NO. 21-0801-S-DU TOWN OF CEDAR GROVE, KANAWHA PUBLIC SERVICE DISTRICT, and WEST VIRGINIA-AMERICAN WATER COMPANY, Proceeding to determine whether the Town of Cedar Grove is a Distressed or Failing Utility under W. Va. Code 24-2H-1. NOTICE OF PUBLIC COMMENT AND EVIDENTIARY HEARING On November 18, 2021, the Public Service Commission opened a proceeding to consider whether the Town of Cedar Grove is a distressed or failing utility under W. Va. Code 24-2H-1 et seq. The Town of Cedar Grove provides service as a public sewer utility to approximately 347 customers in the community of Cedar Grove, Kanawha County, West Virginia. The Public Service Commission will conduct a hearing beginning at 10:30 a.m. Monday, August 15, 2022, at the Cedar Grove Elementary School Cafeteria, 200 John Street, Cedar Grove, West Virginia, to receive public comments regarding, but not limited to, whether the Cedar Grove Sewer Utility is a distressed or failing utility and, if so, possible options available to bring the distressed or failing utility into compliance with appropriate statutory and regulatory standards concerning actual or imminent public health problems or unreasonable quality and reliability service standards. After receiving any public comment, the Commission will begin the evidentiary hearing to address the statutory elements of the Distressed and Failing Utilities Improvement Act W. Va. Code 24-2H-1 et seq., to determine whether Cedar Grove is a distressed or failing utility and whether Kanawha Public Service District and West Virginia American Water Company are capable proximate sewer utilities that could provide services to help Cedar Grove or take over the operations of Cedar Grove. The Commission will receive oral comments at the public hearing on August 15, 2022.
