NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned J. Patrick Jones, Trustee under that certain Deed of Trust dated July 12, 2019, executed by IPI RE, LLC, which deed of trust is of record in the Office of the Clerk of Kanawha County, West Virginia, in Trust Deed Book 4374 at Page 950, the undersigned Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Trustee will sell the real estate described in the Deed of Trust, at a public auction on September 15, 2022, at 10:00 a.m. to the highest bidder at the front door (Virginia Street, East) of the Courthouse of said County of Kanawha, in Charleston, West Virginia, which real estate is more completely described as follows: All those certain lots, tracts or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on Coopers Creek, Elk District, Kanawha County, West Virginia: PARCEL ONE; Being a 0.49 acre portion of a 22 acre tract located + 850 feet from the intersection of Kanawha County Route 41 and West Virginia Route 114 connector, and more particularly described as follows: BEGINNING at a 1″ iron pipe set in the westerly right of way line of Kanawha County Secondary Route 41 (Coopers Creek Road) said pipe also being in the division line of property formerly owned by Paul and Ruby Ginther, now belonging to the West Virginia Department of Highways; thence leaving said right of way line and running with the said division line and permanent drainage easement line of Federal Highway Project No. QI-79 1 (41)2 and 1-79-1(25) 2, N. 62 degrees 27′ W. 70.63 feet to a concrete monument found 255 feet right of and radial to centerline station 270+25; thence running with said permanent drainage easement and controlled access right of way line, N. 49 degrees 30′ E. 133.55 feet to a concrete monument found 292 feet right of and radial to centerline station 270 degrees 35′ thence leaving said right of way line, N. 53 degrees 05′ E. 150.62 feet to a 1″ iron pipe set, being a corner to the aforementioned 22 acre tract; thence N. 87 degrees 39′ E. 93.06 feet to a 1″ iron pipe set in the westerly right of way line of Kanawha County Secondary Route 41 (Coopers Creek Road), said pipe also being a corner to the 22 acre tract; thence running with the westerly right of way line of said Route 41, S. 36 degrees 25′ W. 50.25 feet to a 1″ iron pipe set, S. 51 degrees 18′ W. 50.21 feet to a 1″ iron pipe set, and S. 52 degrees 16′ W. 231.79 feet to the place of beginning, containing 0.49 acre more or less, as shown upon a plat of survey prepared by I. Parcel One conveyed by this deed is subject to a drainage easement shown upon a plat of survey prepared by I.A.N. Garcelon under the supervision of J. PARCEL TWO: Being a 793 square foot parcel contiguous to a 22 acre tract of 40 acres, located on the waters of Coopers Creek + 1000 feet from the intersection of Kanawha County Route 41 and West Virginia Route 114 connector, more particularly described as follows: BEGINNING at 1 1″ iron pipe set in the westerly right of way line of Kanawha County Secondary Route 41 (Coopers Creed Road), said pipe being a corner to the aforementioned 22 acre tract and bears S. 13 degrees 53′ W. 330.93 feet from a ONE-HALF” steel pin found marking the northeast corner of a lot now or formerly owned by Alice A. & Herbert H. Halstead property; thence with one line of Halstead S. 79 degrees 11′ E. 74.80 feet to the place of beginning containing 793 square feet more or less, as shown upon a plat of survey prepared by I. A. N. Garcelon under the supervision of J. Bruce Hager, L. L. S #577. Halstead (Deed Book 887, page 405); said beginning point is also the southeasterly corner of property now owned by the party of the first part; thence running with said line, S 87DEGREES 35′ W 80 feet to a point; thence running S 53DEGREES 05′ W 150.03 (erroneously referred to as 180.03 in previous deed) feet to a point in the southerly right of way line of Interstate Route No. 79 (Labeled “A” on the map referenced below); thence running with the right of way line of Interstate 79, N 18DEGREES 11′ E 150.5 feet to a point (Labeled “C” on the map referenced below); thence running in a southeasterly direction with the center of a creek 85 feet more or less, to a point (Labeled “B” on the map referenced below); thence running S 75DEGREES 11′ E 74.80 feet, more or less to the place of beginning, and being shown upon a map dated July 8,1983 made by L. Bruce Hager and attached to a deed dated the 10th day of August, 1994 and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, from Juanita B. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5.
