NOTICE OF OPPORTUNITY FOR PUBLIC COMMENT ON CONSIDERATION OF WELL CASING CEMENTING VARIANCE REQUEST Notice is hereby given that the Chief of the Office of Oil and Gas of the West Virginia Department of Environmental Protection is seeking public comment within the next twenty (20) days on his consideration to grant a variance for the use of API Class L cement. This variance is being considered pursuant to West Virginia Code of State Rules 35-4-18 and 35-8-14. Currently, under West Virginia Code of State Rules 35-4-11.5. and 35-8-9.2.h.8., cement used to fill the annular space around the freshwater and coal protection casing must be API Class A Ordinary Portland cement. The variance, if approved, would allow Class L cement to be used in place of Class A to satisfy this requirement. Based on laboratory testing, Class L cement meets or exceeds all the specific requirements found in West Virginia Code of State Rules 35-4-11 and 35-8-9.2.h. and Chapter 22, Articles 6 and 6A of the West Virginia Code.
