NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by Deed of Trust dated the 20th day of October, 2014, signed by LARRY L. HALL, SINGLE PERSON, to Stephanie L. Abraham, Substitute Trustee, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 4064, at Page 1, and Stephanie L. Abraham, acting as Substitute Trustee, by virtue of the Appointment of Substitute Trustee dated July 29, 2022, having been recorded in the aforesaid Clerk’s Office, said Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said Deed of Trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 9:15 o’clock a.m. on the27th day of September, 2022, at the front doors of the Courthouse in Kanawha County, 409 Virginia Street, East, in Charleston, West Virginia, 25301, the following described real estate: All those certain lot or parcel of real estate situate, lying and being on the in Charleston West District, Kanawha County, West Virginia, described as follows: And being the rear 33 feet off of said Lot No. One (1) in Block D of Fitzgerald Addition, being more particularly described as follows: BEGINNING at a point in the easterly line of Barlow Street, now known as Fitzgerald Street, which point is 80 feet from a point of intersection of said easterly line of Fitzgerald Street, with the southerly line of Third Avenue, now Grant Street; thence with the easterly line of Fitzgerald Street in a southerly direction of distance of 33 feet to the northerly line of an alley; thence with the northerly line of said alley in an easterly direction a distance of 60 feet to a stake at the corner of Lot No. Two (2) of said Block D of Fitzgerald Addition; thence with the dividing line of said Lots Nos. One (1) and Two (2) of said Block D in a northerly direction of distance of 33 feet to a stake; thence leaving said dividing line and in a parallel with the northerly line of said alley in a westerly direction distance of 60 feet to the place of beginning, a being the rear 33 feet off of said Lot No. One (1) of Block D of said Fitzgerald Addition. And being the same real estate conveyed to Larry L. Hall and Nancy C. Hall, husband and wife. as joint tenants with right of survivorship. by a deed dated July 2, 2009. from Whitesville State Bank, ofrecord in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book No. 2750, at page 375. Nancy C. Hall died on September 30, 2013, vesting title to the hereinabove described real estate to her husband, Larry L. Hall, pursuant to the survivorship provisions in the aforementioned deed. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above described real estate is reported to have a mailing address of: 210 Fitzgerald St., Charleston, WV 25302. TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees. Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. The party(ies) secured by the Deed of Trust reserved the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property the next highest bidder. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry.
