BEFORE THE COUNTY COMMISSION OF CABELL COUNTY, WEST VIRGINIA IN RE: PETITION OF BIG GREEN PROPERITES, II LLC, A WEST VIRGINIA LIMITED LIABILITY COMPANY FOR THE CLOSING AND VACATING OF AN UNUSED ROADWAY LOCALLY KNOWN AS INDIAN HEAD DRIVE AND OF A PORTION OF AN UNUSED, UNNAMED ALLEY WAY ON THE EAST SIDE OF INDIAN HEAD DRIVE Notice is hereby given that the above stated Petition shall be brought before the County Commission of Cabell County, West Virginia at it’s meeting on Thursday September 22, 2022 at 10 o’clock AM at the Cabell County Courthouse, 750 5th Avenue, Huntington, WV, Suite 300 at which time and place any interested parties may appear and protect their interests if they so desire. The roadway to be abandoned is described as follows: All that certain lot piece or parcel of land situated in Guyandotte District, Cabell County, West Virginia and more particularly described as follows: BEGINNING at a rebar at the intersection of the west line of West Pea Ridge Road and the easterly line of a .675 area parcel (Deed Book 1440, at Page 422); thence, with said easterly line, S 06DEGREES 43′ 26″ E, 99.00 feet to a rebar in the northerly line of a 2.219 acre parcel (Deed Book 1440, at Page 418); thence with the said northerly line N. 74DEGREES 41′ 22″ E 32.10 feet to a rebar at the most northerly corner of the 2.219 acre parcel; thence with the easterly line of the 2.219 acre parcel S 12DEGREES 00′ 57″ E 462.15 feet to a point at the southeasterly corner of the 2.219 acre parcel and in the north line of Interstate 64; thence, with the north line of Interstate 64 N 66DEGREES 34′ 07″E 34.60 feet to an iron pipe at the corner of Pea Ridge PSD (Deed Book 825, at Page 363); thence, N 12DEGREES 00′ 57″ W 86.60 feet to an iron pipe at the southerly corner of a .192 acre parcel (Deed Book 1440, at Page 418); thence, continuing with the west line of the .192 acre parcel, N 12DEGREES 00′ 57″ W 188.70 feet to a point at the intersection of the said west line and the south line of an unimproved alley; thence, with said south line S 84DEGREES 22′ 25″ E 93.22 feet to the most easterly corner of the .192 acre parcel; thence, severing the unimproved alley in a north easterly direction to the southeast corner of Lot 2 of F. H. Medley’s Upland Terrace Subdivision (Deed Book 1440, at Page 418); thence, with the south line of Lot 1 (Deed Book 1440, at Page 418) and Lot 2 of said subdivision N 84DEGREES 22′ 25″ W 113.35 feet to a rebar at the south westerly corner of Lot 1; thence, with the westerly line of Lot 1, N 12DEGREES 00′ 57″ W 200.20 feet to a rebar at the north westerly corner of Lot 1 and in the south line of West Pea Ridge Road; thence, with the said south line N 55DEGREES 18′ 34″ W 82.83 feet to the point of BEGINNING.
