NOTICE OF EMERGENCY INTERIM SOLID WASTE COLLECTION RATE INCREASE On June 30, 2022, RGL, Inc., dba Mountain State Waste (MSW) applied for increased rates and charges under two recently acquired motor carrier certificates where it now provides service using the process provided under W.Va. Code 24A-5-2a. MSW provides solid waste collection to customers formerly served by E&L, Inc., and N&P Trucking in portions of Kanawha, Putnam and Mason Counties. It represented that the current rates are inadequate and that MSW is incurring losses on a cash flow basis. Thus, MSW requested an increase of 33.6 percent for providing service under M.C. Certificate No. F-4691 and an increase of 43.8 percent for providing service under M.C. Certificate No. F-5784. MSW also requested emergency interim rates applicable during the pendency of the rate proceeding. The interim rate request represents an increase of 24.4 percent for customers served under M.C. Certificate F-4691 (former E&L, Inc., customers) and an increase of 30.24 percent for customers served under F-5784 (former N&P Trucking, LLC customers). On the recommendation of Commission Staff, the Commission approved the emergency interim rate increase for all solid waste collection bills rendered on or after the effective date of the Order. The specific rates approved are as follows: Residential M.C. No. F-4691 Present Rate $19.65 Interim Rate $24.12 Percent Increase 24.4 Residential M.C. No. F-5784 Present Rate $14.79 Interim Rate $19.26 Percent Increase 30.24 Commercial M.C. No. F-4691 Present Rate Negotiable Interim Rate Negotiable Percent Increase 24.4 Commercial M.C. No. F-5784 Present Rate Negotiable Interim Rate Negotiable Percent Increase 30.24 This emergency interim rate increase is applicable to MSW customers served in portions of Kanawha, Putnam and Mason Counties. The emergency interim rates are subject to refund if not justified by an ongoing Staff review and final decision in this matter. Customers may examine the specific emergency interim rate changes at the MSW offices or on the Commission website.Theserates are interim rates only and may be increased, decreased or leftunchanged at the conclusion of this proceeding. During the course ofthis proceeding, the Staff of the Commission will recommend finalrates for the applicable MSW customers. Those rates were previouslymailed to impacted customers by MSW.
