NOTICE OF TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned, J. Nicholas Barth, Successor Trustee, by that certain Deed of Trust made by Mary F. Huffman to P. Michael Pleska and F. Thomas Graff, Jr., Trustees, bearing date May 14, 1999, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 2541 at page 573; the said J. Nicholas Barth acting as Successor Trustee by virtue of that certain Appointment of Successor Trustee dated the 8th day of September, 2022, of record in the aforesaid Clerk’s Office in Trust Deed Book 4607 at page 873; and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, the undersigned Successor Trustee will offer for sale, at public auction, to the highest bidder at the North Front Door of the Courthouse of Kanawha County, West Virginia, in the City of Charleston, West Virginia, on Wednesday, the 12th day of October, 2022, at 10:15 o’clock a.m., all that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Dunbar, Union District, Kanawha County, West Virginia, and being more particularly bounded and described as follows: BEING known and designated as all of Lot Number Twenty-Three (23) and twenty-eight (28) feet of Lot Number Twenty-Two (22), immediately adjoining and to the south of said Lot Number Twenty-Three (23), Block Fourteen (14) of the City of Dunbar; And being the same property conveyed unto Mary Frances Huffman, by Jody G. Cavener and Niccole E. Cavener, by deed dated May 14, 1999, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2470 at page 06. Said property having address of 2000 Dunbar Avenue, Dunbar, WV 25064. The referenced property will be conveyed with covenants of special warranty subject to all further covenants, conditions, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground. TERMS OF SALE: Cash in hand at time of sale, subject to all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. Pursuant to the terms of the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
