NOTICE OF COMMENT PERIOD FOR DRAFT f%] PROPOSED ACID RAIN PERMIT RENEWAL Under Phase II of the Acid Rain Program (40 CFR 72 and 45CSR33), the West Virginia Department of Environmental Protection, Division of Air Quality (DAQ) proposes to approve a Phase II Acid Rain Renewal Permit, R33-3935-2027-6, for Units 1, 2 and 3 at Appalachian Power Company’s John E. Amos Power Station located near St. Albans, West Virginia. The renewal permit specifies the following total sulfur dioxide (SO2) allowances allocated by the U. S. Environmental Protection Agency (USEPA) to each utility boiler (unit) at the John E. Amos Power Station: 22,630 allowances in the calendar years 2023, 2024, 2025, 2026 & 2027 to Unit 1; 25,944 allowances in the calendar years, 2023, 2024, 2025, 2026 & 2027 to Unit 2; and 41,584 allowances in the calendar years 2023, 2024, 2025, 2026 & 2027 to Unit 3. One allowance authorizes the unit to emit one ton of sulfur dioxide. The renewal permit specifies an approved nitrogen oxide (NOx) emissions compliance plan effective for calendar years 2023, 2024, 2025, 2026 & 2027 for each utility boiler (Unit 1, Unit 2, and Unit 3) at the John E. Amos Power Station. Under the plan, Unit 1’s actual annual average NOx emission rate shall not exceed the applicable limitation of 0.46 lb mBtu as set forth in 40 CFR 76.7(a)(2) for Group 1, Phase II dry bottom, wall fired boilers, Unit 2’s actual annual average NOx emission rate shall not exceed the applicable limitation of 0.46 lb mBtu as set forth in 40 CFR 76.7(a)(2) for Group 1, Phase II dry bottom, wall fired boilers and Unit 3’s actual annual average NOx emission rate shall not exceed the applicable limitation of 0.68 lb mBtu as set forth in 40 CFR 76.6(a)(1) for Group 2 cell burner boilers. The renewal permit does not affect the Amos Power Station’s responsibility to meet all other existing local, state and federal requirements related to SO2 and NOx emissions. All written comments submitted by the public and affected state(s) pursuant to this notice must be received by the DAQ within thirty (30) days of the date of publication of this notice. Under the Direct proposed procedures of 40 CFR 72.72(b)(1)(v), if no significant, adverse comments are timely submitted, the proposed permit will be deemed issued on the publication date of this notice or from the date the USEPA receives this draft roposed permit, whichever is later. Written comments submitted by the USEPA must be received by the DAQ within forty-five (45) days from such date. If significant, adverse comments are timely submitted, the proposed permit will be issued in accordance with 40 CFR 72.72(b)(1)(iv). In the event that the 30th/45th day is a Saturday, Sunday, or legal holiday, the comment period will be extended until 5:00 p.m. on the following regularly scheduled business day. The submission shall include the commenter’s name and address, the commenter’s interest in this matter and the affiliation, if any, the commenter has to the owner or operator of the unit(s) covered by the renewal permit. All relevant, timely comments will be considered except for those pertaining to any standard requirement under 40 CFR 72.9 and issues not related to the renewal permit, such as the environmental effects of acid rain or permit issuance procedures or actions on other permit applications not relevant to the issuance or denial of the renewal permit. Any person who requests a public hearing must state the issues proposed to be raised in the hearing. If the DAQ finds that a hearing will contribute to the decision-making process by clarifying significant issues affecting the draft roposed renewal permit, a hearing will be announced.
