Homan, Exco Production Company West Virginia, LLC, Frontier West Virginia, Inc., Pendleton Community Bank, Inc., Ceason Ranson, Trustee, Ellen S. Cappellanti, Trustee, Charles W. Loeb, Jr., Trustee, Unknown Persons wners, and Ross H. Mellinger, Sheriff of Jackson County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation ight of Entry has been filed in the Circuit Court of Jackson County, West Virginia, and is known as Civil Action No. CC-18-2022-C-80, and styled AEP West Virginia Transmission Company, Inc. vs. Thomas R. Homan, et al. Said Petition for Condemnation ight of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of AEP West Virginia Transmission Company, Inc. situate, lying, and being in Ripley District, Jackson County, West Virginia, identified as Tax Map 28, Parcel 32, and recorded in the office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book 325, at page 176, and being more specifically bounded and described as follows: 300 AC PARCHMENT PARCEL NO. 1. Those certain tracts and parcels of land containing an aggregate acreage of approximately 154 acres on Parchment Creek, and charged on the 1985 Land Books of Ripley Tax District as 154 acres. Parchment, St. Rt. 15-5, in the names of Floyd M. Sayre, Jr., et als; PARCEL NO. 2. That certain tract of land containing 32 acres, more or less, situate on Angel Ridge, on the waters of Parchment Creek, and charged on the 1985 Land Books of Ripley Tax District as a part of a 204 acre tract, Parchment, in the names of Floyd M. Sayre, Jr., et als; PARCEL NO. 3. Those certain tracts of parcels of land containing 106 acres and 30 acres by estimation, more or less, on the waters of Cox’s Fork and Parchment Creek, and charged on the 1985 Land Books of Ripley Tax District as a part of a 204 acre tract, Parchment, in the names of Floyd M. Sayre, Jr., et als; PARCEL NO. 4. That certain tract or parcel of land containing 80 acres, more or less, situated on the waters of Cox’s Fork, and charged on the 1984 Land Books or Ripley Tax District as a part of a 204 acre tract, Parchment, in the names of Floyd M. Sayre, Jr., et als; PARCEL NO. 5 That certain tract of parcel of land containing 16 acres and 36 rods, more or less, on the waters of Parchment Creek, and charged n the 1985 Land Books of Ripley Tax District as 16.5 acres, Parchment, in the names of Winifred Sayre and Dollie Sayre Jordan; There is EXCEPTED and RESERVED from the properties described herein by Dale Welling and Connie Welling in the aforementioned deed 100 acres from the 400 acres described herein. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation ight of Entry may be obtained from the Jackson County Circuit Clerk’s office at 100 Court Street, Ripley, West Virginia, 25271, for the purposes of appearing and defending. The Petition for Condemnation ight of Entry may also be obtained from the attorneys for AEP West Virginia Transmission Company, Inc., Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation ight of Entry will occur on January 19, 2023, at 3:00 p.m., in the Circuit Court of Jackson County, West Virginia, located at 100 Court Street, Ripley, West Virginia, 25271, before the Honorable Lora Dyer. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
