Mellinger, Sheriff of Jackson County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation ight of Entry has been filed in the Circuit Court of Jackson County, West Virginia, and is known as Civil Action No. CC-18-2022-C-81, and styled AEP West Virginia Transmission Company, Inc. vs. BLC, LLC, et al. Said Petition for Condemnation ight of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of AEP West Virginia Transmission Company, Inc. situate, lying, and being in the waters of Grass Lick and Stone Lick Branch, Ripley District, Jackson County, West Virginia, identified as Tax Map 44, Parcel 8.1.6001, and identified as Tax Map 39, Parcel 48, and recorded in the office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book 483, at page 834, and being more specifically bounded and described as follows: PARCEL (91 AC) PARCEL (92 AC) FIRST TRACT: BEGINNING at the edge of the right of way of U.S. Route #21, comer to lands of Lavelle Shinn; thence leaving U.S. Route #21 crossing Grass lick Creek N. 76DEGREES 08′ W. 1,401.2 feet to a stake; thence N. 60DEGREES 01′ W. 462 feet to a stake; thence N. 47DEGREES 05′ W. 470 feet to a stake, being a comer to lands of Lavelle Shinn and Estel Simmons; thence N. 3DEGREES 55′ E. 1,208.9 feet to a black oak tree, comer to lands of Estel Simmons and T. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation ight of Entry may be obtained from the Jackson County Circuit Clerk’s office at 100 Court Street, Ripley, West Virginia, 25271, for the purposes of appearing and defending. The Petition for Condemnation ight of Entry may also be obtained from the attorneys for AEP West Virginia Transmission Company, Inc., Stephen F. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation ight of Entry will occur on January 19, 2023, at 3:15 p.m., in the Circuit Court of Jackson County, West Virginia, located at 100 Court Street, Ripley, West Virginia, 25271, before the Honorable Lora Dyer. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
