TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 1, 2019, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, on November 15, 2019, in Book No. 4393, at Page 766, Gayanne M McGraw did convey unto Michael J. Bell, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Nationstar Mortgage LLC d Mr. Cooper to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on December 20, 2022 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 27 – Nitro District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot, piece or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Union District, Kanawha County, West Virginia, and being a part of Lot No. Six (6) of Lee’s Ferry Acres, as shown upon a map of Lee’s Ferry Acres, which said map was made by W. A. Vivien, and is of record in the office of the Clerk of the County Court of Kanawha County, West Virginia, in Map Book 8, at page 10, and also Map Book 10, at page 25, and which said part of Lot No. Six (6) of said Lee’s Ferry Acres, is further shown upon that certain map entitled “No. 221 Lee Street Being Part of Lot 6 Lees Ferry Acres Now in the City of Nitro, in Union District, Kanawha County W. Va. Property of Michael E. George and Sharon L. George”, which said map was made by J. Lewis Hark, Reg. Prof. Engr., dated March 23, 1968, and recorded in aforesaid county in Deed Book 1519, page 375, and which said part of Lot No. Six (6) is more particularly bounded and described as follows: BEGINNING at an iron pin in the northeasterly line of Lee Street, as shown on the aforesaid maps, common comer thereon of Lots Nos. Five (5) and Six (6) of said Lee’s Ferry Acres; thence with the line of Lee Street N. 36DEGREES 54′ W. a distance of 50 feet to an iron pin located in the line of said Lee Street; thence through said Lot no. 6 N. 59DEGREES 26′ E. 117.08 feet to an iron pin; thence through said Lot No. 6, S. 30DEGREES 45′ E. 49.61 feet to an iron pin in the common division line between said Lots Nos. 5 and 6 of said Lee’s Ferry Acres; thence with he common division line between said Lots Nos. 5 and 6 of said Lee’s Ferry Acres S. 59DEGREES 26′ W. 111.58 feet to the place of beginning. And being the same property conveyed unto Michael E. George and Sharon L. George from Paul E. Lee and Virginia Nell Lee by deed dated April 8, 1968 and of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 1519, page 375. The said Sharon L. George died on December 8, 2006, leaving the subject property vested in Michael Edward George by joint tenancy. The said Michael Edward George died on August 12, 2016, leaving the subject property vested in Dianna Michele George Lockhart by his Last Will and Testament. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 221 Lee Ave, Nitro, WV 25143-2303. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $8000.00 in cash and r certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
