NOTICE OF SUCCESSOR TRUSTEES’ SALE OF REAL PROPERTY Notice is hereby given that, by virtue of the authority vested in the undersigned Katie L. Monroe and James M. Davis, as Successor Trustees, by a Credit Line Deed of Trust made and executed by Catherine A. Conner to James C. Gardill, as Trustee, dated December 14, 2010, recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 3768, at Page 550 (the “Deed of Trust”); and the said Katie L. Monroe and James M. Davis, acting as Successor Trustees under and by virtue of a certain Notice of Appointment of Successor Trustees, dated November 26, 2019, and recorded in the aforesaid Clerk’s office in Trust Deed Book 4397, at Page 534; and default having been made in the payment of the note secured by the Credit Line Deed of Trust, the owner and holder of said note, having elected to treat the whole principal debt secured by the Credit Line Deed of Trust as immediately due and payable and having requested in writing the sale of the real estate conveyed by the Credit Line Deed of Trust; NOW, THEREFORE, the undersigned Successor Trustees, having been required so to do by said holder, WesBanco Bank, Inc., will sell the real estate conveyed by the Credit Line Deed of Trust at public auction, together with Joe R. Pyle Auctions, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, in the City of Charleston, West Virginia, on January 14, 2020, at 2:00 p.m., local time, and which said real estate is more particularly described in the Deed of Trust as follows: All that certain piece or parcel of land situate on the west side of that certain forty (40) foot road known as Chappell Hollow Road in Chappell Hollow, Loudon District, Kanawha County, West Virginia, more particularly described as follows: BEGINNING at a point marked by an iron pin located in the westerly sideline of Chappell Hollow Road marking the southeast corner of a lot conveyed to James S. Davis & Co., a corporation, by deed of Kanawha City Company, a corporation, said deed being dated the 17th day of May, 1954, and now of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia; thence from the beginning point and leaving the westerly sideline of Chappell Hollow Road and with the southern sideline of the said lot sold to James S. Davis & Co., a corporation, by deed dated the 17th day of May, 1954, N 66 48′ W. 485.1 feet to an iron pin located in the rear line; thence with the rear line S 15 00′ W 29.6 feet to an iron pin; thence leaving the rear line S 54 51′ E 546.6 feet to an iron pin located in the westerly sideline of Chappell Hollow Road; thence with the westerly sideline of Chappell Hollow Road and with a curve which has a radius of 90.0 feet and along the arc of the curve the chord of which has a course and distance of N. 14 44′ E. 61.65 feet to an iron pin; thence continuing with the westerly sideline of Chappell Hollow Road N. 5 40′ W. 94.0 feet to the place of beginning. And being the same property as was conveyed unto Catherine A. Conner by deed dated May 28, 1992 from Danielle C. Decker and Ferdinand A. Decker, III, of record in the aforesaid Clerk’s office in Deed Book 2293, at page 150, and also being the same property which was quitclaimed to Catherine Conner by Danielle L Decker, and Ferdinand A. Decker, III, by Quitclaim Deed dated, June 3, 2009 of record in the Office of Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 2747, page 310. This conveyance is made subject to such rights of way, easements, restrictions, covenants, conditions and reservations as may be found in prior deeds of record in the chain of title. At the time of the execution of the Credit Line Deed of Trust the property address was reported to be: 877 Chappell Road, Charleston, WV. The above-described real estate will be conveyed by the undersigned Successor Trustees by deed without warranty of any kind, express or implied, and subject to all prior liens, and further subject to all unpaid real estate taxes or assessments, encumbrances and claims in favor of public service districts / municipal sanitary boards, if any, and also further subject to any covenants, restrictions, conditions, reservations, rights of way and easements of record in the aforesaid Clerk’s office and affecting the subject real estate, and without responsibility for or representations as to any items of personal property located thereon; and, any party claiming an interest in any item of personal property is responsible for the removal thereof prior to the date of sale. TERMS OF SALE 1. Ten Percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) nonrefundable down payment required on day of sale along with a Ten Percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) Buyers Premium to be added and due on the day of sale with the balance due at closing by certified or cashier’s check, or cancellation of existing indebtedness in the discretion of the Successor Trustees. No financing contingencies and closing to take place within thirty days (30) of the day of sale; 2. Subject to any prior deeds of trust or security agreements of record; 3. Subject to any special assessments or any liens for taxes; 4. The successful bidder shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 5. The above-described real estate will be sold by the undersigned Successor Trustees by auction to the highest bidder subject to the right of the undersigned Successor Trustees to reject all bids if, in their opinion, said bids are inadequate; 6. The owner of the indebtedness secured by the Deed of Trust shall have the right to bid; and 7. The above-described real estate will be sold in “AS IS” condition.
