Gillespie’s Unknown Heirs, Emma Gillespie’s Unknown Heirs, Emi E. Gillespie’s Unknown Heirs, Roscoe B. Gillespie’s Unknown Heirs, Myrtie Coleman’s Unknown Heirs, Ross G. Childress, John Coleman Pignato, Roberta P. Fowlkes, Melinda J. Pignato, Kevin G. Young, Dale Guy Young, Bennington Green Homeowners Association, Inc., Putnam County Bank, Bennington Development, Inc. and its Unknown Shareholders, J. R. Wilson, Trustee, Alexander J. Rutherford, Sheriff of Kanawha County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that an Amended Petition for Condemnation ight of Entry has been filed in the Circuit Court of Kanawha County, West Virginia, and is known as Civil Action No. 23-P-109, and styled Appalachian Power Company vs. Joseph Gillespie’s Unknown Heirs, et al. Said Amended Petition for Condemnation ight of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate and being in the County of Kanawha, and State of West Virginia, on Howards Fork of the Rocky Fork of Pocatalico River, identified as Tax Map 22, Parcel 14, and recorded in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book S, at page 545, and being more specifically bounded and described as follows: INDETERMINATE AMOUNT OF ACRES, A REMNANT OF 260 ACRES Beginning at Ias McCowns corner, thence with McCowns line, thence to James Roberts and with the same to the Military, thence with the Military to Bullits and with Bullits line to James Andersons and with Andersons to the Turnpike, and with the Turnpike to Druciller Powers corner, thence with the same to the place of Beginning, containing two hundred and Sixty Acres, more or less. The aforementioned respondents are hereby notified a copy of said Amended Petition for Condemnation ight of Entry may be obtained from the Kanawha County Circuit Clerk’s office at 111 Court Street, Charleston, West Virginia, 25301, for the purposes of appearing and defending. The Amended Petition for Condemnation ight of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. The aforementioned respondents are further notified that a hearing on the said Amended Petition for Condemnation ight of Entry will occur on July 11, 2023, at 10:00 a.m., in the Circuit Court of Kanawha County, West Virginia, located at 111 Court Street, Charleston, West Virginia, 25301, before the Honorable Jennifer F. Bailey. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
