TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated August 27, 2007, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 3502, at Page 830, Kermit W. Halstead amd Carolyn Kay Halstead did convey unto Transtar National Title, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on July 25, 2023, at 5:57 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Elk District, Kanawha County, West Virginia, and more particularly described as follows: All of the following two tracts of land which are more particularly bounded and described as follows: Parcel Number One: the surface only of all of that certain lot or parcel of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate on Aarons Fork of Little Sandy, Elk District, Kanawha County, West Virginia and being more particularly bounded and described as follows: Beginning at an “X” on the north end of the east wing wall of a culvert under West Virginia Local Service Route No. 39, said “X” being located the following bearing and distance north 48 degrees 54 minutes west 646.20 feet, north 51 degrees 31 minutes west 110.00 feet, north 47 degrees 33 minutes west 56.57 feet from an iron pin being the northwesterly corner of the Antioch Church lot, thence with the northeasterly right of way line of Local Service Route No. 39, north 52 degrees 58 minutes west 221.82 feet to an iron pin, thence leaving said right of way line north 59 degrees 12 minutes east 90.65 feet to an iron pin, thence north 30 degrees 02 minutes east 169.33 feet to a large white oak, thence south 50 degrees 33 minutes east 112.59 feet to an iron pin, thence south 15 degrees 46 minutes west 153.27 feet to the beginning, containing 0.87 acres, more or less, and as more particularly shown by a Plat made by C.T. Tolley, Jr. under date of October 14, 1972, and which is attached to and made a part of that certain Deed dated the 9th day of November, 1972 and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1673 at page 574. There is expressly excepted and reserved from the above-described Parcel Number One an outconveyance executed by Opal C. Moore formerly Opal C. Harding, widow, unto Kelsey H. Harding and Charlotte E. Harding, his wife, bearing date June 16, 1989, recorded in the aforesaid Clerk’s Office in Deed Book 2227, at Page 579, which conveys a parcel of real estate containing 0.17 acres, more or less. Parcel Number Two: All of that certain tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Elk District, Kanawha County, West Virginia, being more particularly bounded and described as follows: Beginning at a point in the line of an 0.85 acre tract, said point bearing south 51 degrees 04 minutes east 44.97 feet from a large white oak being a common corner to said 0.85 acre and a 1.02 acre tract, thence and crossing a 0.39 acre tract north 36 degrees 10 minutes 25 seconds east 44.27 feet to a point in the boundary line between Harding and James Dodd, thence with Dodd’s line south 27 degrees 03 minutes east 22.00 feet to a point being a corner to the said 0.39 acre tract, thence with another line of said .039 acre tract and following a small branch south 5 degrees 32 minutes east 65.17 feet to a point being a common corner to the 0.39 acre tract and the aforesaid 0.85 acre tract, thence and with another line of said 0.85 acre tract north 51 degrees 04 minutes west 65.40 feet to the beginning, and being 0.04 acre, more or less, and also the same as shown on a Plat entitled, “Plat Showing the Lands of Kelsey H. and Charlotte E. Harding by Okie D. Terry, L.L.S. #325 dated April 28, 1998”. Which said Map is attached to the hereinafter to Deed. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1608 Aarons Ford Road, Elkview, WV 25071, f HC 70, Box 21, Elkview, WV 25071. AND BEING the same real estate which was conveyed to Kermit W. Halstead amd Carolyn Kay Halstead, by Deed dated July 25, 1994, from Kelsey H. Harding and Charlotte E. Harding, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2348 at Page 295. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
