NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of authority vested in the undersigned Trustee by that certain deed of trust executed by XTRA INCORPORATED to K. E. MCGINNIS AND J. MAURICE CLARK, dated the 4TH day of DECEMBER, 2013, securing HUNTINGTON FEDERAL SAVINGS BANK, and recorded in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book No. 2514, at page 78, by which was conveyed to the said Trustees the hereinafter described real estate, to secure the payment of a certain note set out and described therein, and the owner and holders of said note, in exercise of the right and authority granted in the aforementioned deed of trust, having appointed KERRY E. ADKINS as Substitute Trustee, by that certain Appointment of Substitute Trustee dated the 18TH day of JULY, 2023, and recorded in the aforesaid Clerk’s Office in Bonds, Contracts and Leases Book 416, at page 74, and default having been made in the payment of said note, and the said KERRY E. ADKINS, Substitute Trustee, having been requested so to do by the owner and holder of said note, shall sell to the highest and best bidder, on AUGUST 16, 2023 at 12:00 P.M., at the EAST FRONT DOOR of the Court House of Cabell County, West Virginia, the following described real estate: 328 WILLARD COURT, HUNTINGTON WV 25703 All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Huntington, Gideon District, Cabell County, West Virginia, known and designated as Lot Number Ten (10), as shown on Map of the Varnum and Crook Subdivision of Lots Numbers 33, 34, 35, 36 and 37 of Block Number 240, in Willard Court, said Map being filed in Deed Book No. 218, at page 88, in the Office of the Clerk of the County Commission of Cabell County, West Virginia. 405 HOMESTEAD PLACE, HUNTINGTON, WV 25703 All that certain lot, piece or parcel of ground situate in the City of Huntington, Cabell County, West Virginia, known and designated as LOT NUMBER THREE (3) on the map of a Subdivision of Lots Number 11, 12, 13, 14, 15 and 16, in Block Number 241, which subdivision is known as Varnum and Crook’s Subdivision Number Two (2), and a copy of which map is recorded in the Cabell County Court Clerk’s Office in Deed Book Number 218, at page 87, said lot being in that part of said Subdivision known as “HOMESTEAD PLACE”, and being a parcel of ground thirty by eighty – five (30 x 85) feet. TERMS OF SALE: The trustee’s sale shall be open to online bidders. A 10% buyer’s premium will be added to the high bid for the Real Property. The high bidder shall pay the buyer’s premium plus an additional 10% of its bid on the day of the sale (the “Good Faith Deposit”), with the balance to be paid in cash at closing within 30 days after the date of sale. The sale is made subject to any and all unpaid real estate taxes. Buyer will pay for the deed preparation and transfer tax. Each property described in the aforementioned Deed of Trust shall be auctioned individually. Following the initial auction of the real estate described herein pursuant to this notice, such real estate, together with all real estate auctioned pursuant to other notices of trustee’s sales for the same borrower and scheduled for the same time, shall be offered as a single auction lot. If the highest bid for such single auction lot exceeds the total of the highest bids received at the initial auctions held pursuant to all such notices, then such bid for such single auction lot shall be the winning bid and shall upset the bids at all such initial auctions.
