NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated November 16, 2001, executed by Borrower(s), Carolyn R. Barr and Juanita Barr, to John Ballengee, the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 1714, at Page 431. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 404 Parkway Drive, Huntington, WV 25705. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated June 26, 2023, of record in the Clerk’s Office in Book 415, Page 720. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: 13th day of September, 2023 at 10:15 a.m. All that certain lot, piece or parcel of land situate in the City of Huntington, Cabell County, West Virginia, known and designated on a revised Map of Arlington, a copy of which was filed in the aforesaid Clerks office on the 30th day of December, 1926, in Map Book 3, Map 68, as lots Numbers One Hundred Ninety-two (192), One Hundred Ninety-three (193) and part of Lots Numbers One Hundred Ninety-one (191) and One Hundred Ninety-four (194) and being more particularly bounded and described as follows: Beginning at a point in the westerly line of Parkway Drive where it joins Sumner Avenue, at or near the easterly corner between Lots 194 and 195, which point is southerly with a curve to the right having a radius of 159.58 feet, a distance of 132.39 feet from a point of curve, which in turn is distant S 27DEGREES 40` E, 113.18 feet from a point of Tangent in said line of Sumner Avenue, which is within Lot 199; thence from said beginning and with the line of Parkway Drive, curving right southwesterly with a radius of 159.58 feet, a distance of 54.23 feet; thence continuing with said Drive S 39DEGREES 20` W 91.00 feet; thence leaving said Parkway Drive, N 62DEGREES 40` W 115.51 feet; thence curving left northeasterly with a radius of 180.00 feet, a distance of 79.58 feet; through Lot 194, S 73DEGREES 12` E 110.00 feet; thence N 57DEGREES 36` E 50.28 feet to the point of beginning. Being the same property conveyed to Carolyn R. Barr and Juanita Barr by the Deed dated November 14, 2001 and recorded in Deed Book 1086 at Page 668 in the Office of the Clerk of the County Commission of Cabell County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
