NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of authority vested in the undersigned Substitute Trustee by that certain Deed of Trust executed by DAVID DWAYNE YEAGER, individually and BUILDERS DISCOUNT, LLC, a West Virginia Limited Liability Company to Ralph W. Bassett Jr., as Trustee, for the benefit of Michael Stratton and Sara Stratton, dated the 16th day of December, 2013 and of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2521 at Page 251, to secure the payment of certain note set out and described therein, and default having been made in the payment of said note, the said Ronald J. Flora, having been appointed as Substitute Trustee by instrument of record in the Office of the County Clerk of Cabell County dated the 15th day of August, 2023 in Bonds, Contracts and Leases Book Page 416 at Page 341 and further the undersigned Substitute Trustee having been requested to do so by the holder of said note, shall sell to the highest and best bidder, on 28th day of September, 2023 at 9:30 o’clock a.m., at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, the real estate, conveyed by said Deed of Trust together with the improvements thereon and the appurtenances thereunto belonging, and being more particularly described therein as follows: All that certain piece, parcel or tract of real estate situate in the Town of Milton, Cabell County, West Virginia, bounded and described as follow, to-wit: BEGINNING at a point in the center of a private alley (which is the continuation south of a regular alley) running north and south in the north line of J.H. Hall’s land, the old John Harshbarger place, and running a straight course about south to the north line (which is also the west line) of the Chesapeake & Ohio Railway Company (the spur tract); thence with the line of the said Chesapeake & Ohio Railway Company’s property northerly to the northeast comer of J.H. Hall’s property, witnessed by the southeast comer of Lot No. 3 in the Plat of the Town of Milton; thence with the north line of J.H. Hall’s property west to the point of BEGINNING, estimated to contain three-fourths of an acre, be the same more or less, this being a sale by the boundary and not the acre. Being the same property conveyed unto Builders Discount LLC, a West Virginia Limited Liability Company from Michael Stratton and Sara Stratton by Deed dated the 16th day of December, 2013 of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia in Deed Book 1297, at Page 111. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied and subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note hereby reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue the sale of the subject property from time to time by written or oral proclamation, which continuances shall be the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property, and r any belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF PURSUANT TOW.VA. CODE 38-1-17. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale with ten (10%) of the sales price shall be paid by cash, cashiers check, or check guaranteed by bank letter of credit in acceptable form, in hand on the day of the sale (the “Good Faith Deposit”), with the balance to be paid in cash at closing within 30 days after the date of sale or such Deposit shall be forfeited.
