CLEMENS, SHERIFF OF LOGAN COUNTY, WEST VIRGINIA Notice is hereby given to United Affiliates Corporation, Ark Land Company nka Ark Land LLC, Allegheny Land LLC, Mingo Logan Coal LLC, Unknown Persons wners, and Paul D. Clemens, Sheriff of Logan County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”) that a Petition for Condemnation ight of Entry has been filed in the Circuit Court of Logan County, West Virginia, and is known as Civil Action No. CC-23-2023-C-69, and styled Appalachian Power Company vs. United Affiliates Corporation, et al. Said Petition for Condemnation ight of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate, lying, and being in Logan County and in the Washington District of Boone County, West Virginia, and identified as Tax Map 28, Parcel 168, and recorded in Deed Book No. 197, at page 870, in the office of the Clerk of the County Commission of Logan County, West Virginia, and bounded and described as follows: 1239.13 SF., SPRUCE FK. TRACT 47: Situate, lying and being in Logan County and in the Washington District of Boone County, West Virginia, and being the same property conveyed to GRANTOR by ( i ) Deed and Deed of Correction from United Affiliates Corporation dated December 21, 1987, and March 19, 1992, respectively, and of record in the Office of the Clerk of the County Commission of Logan County, West Virginia, in Deed Book 456, at Page 567, and Deed Book _____, at Page _____, respectively, and ( ii ) by Warranty Deed dated December 21, 1987, and of record in the Office of the Clerk of the County Commission of Boone County, West Virginia, in Deed Book 185, at Page 38. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation ight of Entry may be obtained from the Logan County Circuit Clerk’s office at 300 Stratton Street, Logan, West Virginia, 25601, for the purposes of appearing and defending. The Petition for Condemnation ight of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation ight of Entry will occur on October 23, 2023, at 1:30 p.m., in the Circuit Court of Logan County, West Virginia, located at 300 Stratton Street, Logan, West Virginia, 25601, before the Honorable Joshua Butcher. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
