NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of authority vested in the undersigned Trustee by that certain deed of trust executed by JOSEPH E. BREAULT, JR. to FLYNN, MAX, MILLER & MILLER, dated the 2nd day of February, 2016, securing HABITAT FOR HUMANITY OF THE TRI-STATE, INC, successors in interest to HUNTINGTON WV AREA HABITAT FOR HUMANITY, INC., and recorded in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book No. 2604, at page 618, by which was conveyed to the said Trustee the hereinafter described real estate, to secure the payment of a certain note set out and described therein, and default having been made in the payment of said note, and the said FLYNN, MAX, MILLER & MILLER, Trustee, having been requested so to do by the owner and holder of said note, shall sell to the highest and best bidder, on October 18, 2023 at 10:00 a.m., at the East Front Door of the Court House of Cabell County, West Virginia, the following described real estate: All that certain lot, piece or parcel of ground located in the City of Huntington, Cabell County, West Virginia, known and designated as Lot T and the southerly one-third (l3/8) of Lot U, upon the map of the Davis Subdivision of the South Half of Block No. 354 which said map was made by Allman & Vickers, Engineers and filed in the Office of the Clerk of the County Commission of Cabell County, West Virginia, on February 13, 1917, recorded in Deed Book 149, at page 55, being particularly bounded and described as follows: BEGINNING at a 51/3″ x 30″ rebar with pink plastic cap stamped “David A. Lee WV PS 2248″ (set) in the westerly right of way line of 14th Street (30′ R ); thence with the said right of way line, S. 10DEGREES 21′ 11″ E. 33.45 feet to a 51/3″ x 30” rebar with pink plastic cap stamped “David A. Lee WV PS 2248″ (set), in the northerly line of an alley 10 feet in width; thence, leaving the said right of way line and with the northerly line of said alley, S. 84DEGREES 26′ 55″ W. 73.30 feet to a 51/3″ x 30″ rebar with pink plastic cap stamped” David A. Lee WV PS 2248″ (set); thence, with the easterly line of said alley, N 05DEGREES 33’05” W 33.33 feet to a 51/3″ x 30″ rebar with pink plastic cap stamped “David A. Lee WV PS 2248″ (set); thence, leaving said alley, N 84DEGREES 26′ 55” E 70.50 feet to the beginning, containing 0.055 acres, as surveyed by David A. Lee, West Virginia Professional Surveyor No. 2248, on February 23, 2015 as shown on the plat recorded in Deed Book 1324, at page 441. TERMS OF SALE: Ten percent (10%) cash in hand on day of sale with the balance due within 30 days, subject to any and all unpaid taxes, and purchaser pays all transfer tax, the deed preparation and recording fee.
