NOTICE OF TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned, J. Nicholas Barth, Successor Trustee, by that certain Deed of Trust made by Hazel Gibson to P. Michael Pleska and F. Thomas Graff, Jr., Trustees, bearing date September 12, 2003, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 3048 at page 826; the said J. Nicholas Barth acting as Successor Trustee by virtue of that certain Appointment of Successor Trustee dated February 23, 2023, of record in the aforesaid Clerk’s Office in Trust Deed Book 4632 at page 626; and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, the undersigned Successor Trustee will offer for sale, at public auction, to the highest bidder at the North Front Door of the Courthouse of Kanawha County, West Virginia, in the City of Charleston, West Virginia, on the 12th day of October, 2023, at 11:00 o’clock a.m., all that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, being known as No. 1519 Virginia Street, East, in the City of Charleston Kanawha County, West Virginia, more particularly bounded and described as follows: BEGINNING at an iron pin in the southerly line of Virginia Street East, between Ruffner Avenue and Elizabeth Streets, said beginning iron pin being also located 438.20 feet along said southerly line of Virginia Street East, from the intersection of the southerly line of Virginia Street East, with the easterly line of Ruffner Avenue; thence running with said line of Virginia Street East, S. 57 38′ E., 31 feet to a stake in said line; thence continuing with said line of Virginia Street, East, S. 60 47′ E., 22.46 feet to a stake in said line; thence leaving said southerly line of Virginia Street, East, and running in a direction toward Kanawha River, S. 38 45′ W., 149.50 feet to a stake in the line of a hedge and fence; thence with said hedge and fence line, N. 45 56′ W., 53.90 feet to a stake; thence running in a direction toward Virginia Street, East, N. 39 32′ E., 149.50 feet to the place of beginning, being also shown upon a plat of survey made by Field Engineering Co., dated December 11, 1965, a copy of which plat is attached thereto, specifically made a part of the property conveyed to Prentice Ashton, by J. B. Crowley and Mary L. Crowley, his wife, by deed dated January 1, 1924, and of record in the office of the Clerk of the County Court of Kanawha County, West Virginia in Deed Book 265, at page 117. Being the same real estate conveyed to Jenner M. Gibson and Hazel Gibson, his wife, as joint tenants with the right of survivorship, by Chares M. Harbeson and Annie Laurie Harbeson by deed dated December 14, 1965, and of record in the aforesaid Clerk’s office in Deed Book 1453, at page 113. The said Jenner M. Gibson died, testate on August 4, 1996, by virtue of survivorship, title was vested in Hazel Gibson. Said property having address of 1519 Virginia Street, East, Charleston, West Virginia. The referenced property will be conveyed with covenants of special warranty subject to all further covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground. TERMS OF SALE: Cash in hand at time of sale, subject to all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. Pursuant to the terms of the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
