NOTICE OF TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned, J. Nicholas Barth, Successor Trustee, by that certain Deed of Trust made by Darrin A. Vanscoy and Holly A. Vanscoy to P. Michael Pleska and F. Thomas Graff, Jr., Trustees, bearing date February 27, 2002, and of record in the Office of the Clerk of the County Commission of Putnam County, West Virginia, in Trust Deed Book 565 at page 523; the said J. Nicholas Barth acting as Successor Trustee by virtue of that certain Appointment of Successor Trustee dated July 20, 2006, of record in the aforesaid Clerk’s Office in Substitution of Trustee Book 796 at page 245; and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, the undersigned Successor Trustee will offer for sale, at public auction, to the highest bidder at the Front Door of the Courthouse of Putnam County, West Virginia, in the City of Winfield, West Virginia, on the 5th day of February, 2020, at 10:30 o’clock a.m., all of that certain lot, tract or parcel of real estate, together with the appurtenances thereunto belonging, situate in Scott District, Putnam County, West Virginia, and being more particularly described as all of LOT SIXTY-FOUR (64), SECTION X, STONEGATE SUBDIVISION, as the same is more particularly shown and designated upon that certain map entitled, “FINAL PLAT OF SURVEY SHOWING STONEGATE SUBDIVISION SECTION X, LOTS 60 THROUGH 64 SECTION IX, LOTS 65, 67A, 67B, 69, 72 & 74, SCOTT DISTRICT, PUTNAM COUNTY, WEST VIRGINIA”, dated March 3, 2000, a copy of which is of record in the aforesaid Clerk’s Office in Map Cabinet C, Slide 721; And being the same property conveyed unto Darrin A. Vanscoy and Holly A. Vanscoy, his wife, by deed dated October 3, 2000, from Estes Development Company of record in the aforesaid Clerk’s Office in Deed Book 414 at page 772. Said property having address of 64 Stoneridge Drive, Hurricane, West Virginia. The referenced property will be conveyed subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground. TERMS OF SALE: Cash in hand at time of sale, subject to all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. Trustee does not warrant title to the above-described real estate and any transfer thereof shall be by special warranty deed. Trustee assumes no responsibility to maintain, preserve or monitor the above described real estate, nor assumes an obligation to ensure that any party or person in possession of said real estate surrenders or vacates said real estate upon completion of the Trustee’s Sale. Pursuant to the terms of the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
