NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated January 2, 2019, executed by Borrower(s), Terri H Conner, to Michael J. Bell, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4342, at Page 866. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 23 Woods Curve, Cross Lanes, WV 25313. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated September 29, 2023, of record in the Clerk’s Office. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 14th day of November, 2023 at 11:45 a.m. All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Union District, Kanawha County, West Virginia, and being more particularly designated and shown as Parcel D upon a plat entitled “Subdivision of W. F. Rustemeyer Property located on Bailey Road, Union District, Kanawha County, W. Va. Scale 1″ = 50`”, made by George French, P. E., dated July 21, 1973, said Parcel D being more particularly bounded and described as follows: BEGINNING at a point located in the southerly exterior line of the Woodrow F. Rustemeyer tract, said point also located N. 83DEGREES 37` W a distance of 157 feet from the intersection of the southerly line of the Woodrow F. Rustemeyer property and the westerly line of Bailey Road; said point also being located at the southwesterly corner of Parcel A of the Woodrow F. Rustemeyer Subdivision; thence continuing with the southerly exterior line of Woodrow F. Rustemeyer property, N. 83DEGREES 37` W a distance of 155 feet to an iron pin; thence running N. 6DEGREES 23′ E a distance of 90 feet to an iron pin; thence running S. 83DEGREES 37` E a distance of 155 feet to an iron pin in the northwesterly corner of Parcel A of said Rustemeyer property; thence running with the common division line between Lots A and D of said Rustemeyer property, S 6DEGREES 23` W a distance of 90 feet to the place of beginning. Being the same property conveyed unto Jordan Wallace, formerly known as Jordan Woods, from Paul S. Howard and John H. Howard, by deed dated April 2, 2015, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 2907, page 578. There is excepted and reserved from this conveyance a 15 foot easement along the northerly line of Lot D as shown on the aforesaid map. Said easement and right of way being herein reserved by the parties of the first part, their heirs and assigns, for their use and the use of adjoining property owners. It being understood and agreed between the parties hereto that said 15 foot easement and roadway shall not be blocked or obstructed in any way and that no vehicles, trailers or other similar personal property shall be parked or located on said 15 foot easement at any time. The parties of the first part do further grant and convey to the parties of the second part the right to use that certain 9 foot asphalt drive extending along the northerly line of the Rustemeyer property from Bailey Road back to the Rustemeyer residence and the parties of the first part do further grant and convey to the parties of the second part the right to use that certain 15 foot road way extending from the 9 foot Rustemeyer private drive along the rear of Lots B and C and the northerly line of Lots D and E of the Rustemeyer Subdivision. It being understood and agreed between the parties hereto that the above 9 foot easement and 15 foot easement shall be used exclusively be the owners of Lots A, B, C, D, E and F and other parties purchasing from W. F. Rustemeyer who would own property abutting said right of way and easements and that said right of way shall be used as a means of ingress and egress from Bailey Road to the property herein conveyed and abutting thereon and shall be jointly used with other parties owning property herein. It is further understood between the parties hereto that these roadway are not to be blocked or obstructed in any way and that no vehicle or trailers of any type are to be parked thereon and that the parties of the second part, their heirs and assigns shall pay their prorated on the basis of the front footage of each lot owner abutting and fronting on the said right of way and easements. There is further excepted and reserved from this conveyance all minerals together with the necessary right to remove the same, said minerals having been previously reserved. Being the same property conveyed to Terri H Conner by the Deed dated December 13, 2018 and recorded in Deed Book 3019 at Page 633 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
