FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS January 10th 2024 City of Huntington 800 5th Avenue Huntington, WV 25701 304-696-5540 These notices shall satisfy two separate but related procedural requirements for activities proposed to be undertaken by Habitat for Humanity of the Tri-State, Inc. REQUEST FOR RELEASE OF FUNDS On or around January 26th, 2024, the City of Huntington will submit a request to the U.S. Department of Housing and Urban Development for the release of HOME funds under the HOME Investment Partnership Program (Title II of the Cranston-Gonzales National Affordable Housing Act of 1990, as amended). The purpose is to undertake the following actions: 2021 HOME Program Income Funds: Utilized for the acquisition of materials and services for the construction of a single-family residence at 4718-22 Piedmont Rd, Huntington, WV 25704. Estimated 2021 HOME cost: $48,387.00. 2022 HOME Program Income Funds: Further support for the acquisition of materials and services for the same project. Estimated 2022 HOME cost: $11,653.00. Overall Project Cost: The overall project cost is projected to reach $100,462.00 upon completion. MITIGATION MEASURES As part of the Environmental Review Record, the following mitigation measures have been identified and will be implemented to address potential flood risks associated with the project: Flood Insurance – Flood Disaster Protection Act of 1973 and National Flood Insurance Reform Act of 1994: Continuous flood insurance is mandated for the entirety of the structure’s lifespan in accordance with the Flood Disaster Protection Act of 1973 and National Flood Insurance Reform Act of 1994 42 USC 4001-4128 and 42 USC 5154a . This measure is in place to safeguard against potential flood risks, aligning with local regulations and ensuring sustained protection. Floodplain Management – Executive Order 11988 and 24 CFR Part 55: The project site falls within a Special Flood Hazard Area (SFHA), and as such, it is subject to guidelines outlined in Executive Order 11988, particularly section 2(a), and 24 CFR Part 55. Furthermore the project is subject to the guidelines stipulated in the City of Huntington’s flood zone ordinance. In adherence to these guidelines, comprehensive measures will need to be integrated into the project design to mitigate flood risks, ensuring the safety and resilience of the proposed development in the face of potential flooding events. FINDING OF NO SIGNIFICANT IMPACT The City of Huntington has determined that the project will not have a significant impact on the human environment. As a result, there is no need for an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA). Further details regarding the project can be found in the Environmental Review Record (ERR) available for review and duplication at the Office of Development & Planning, located at 800 5th Avenue, Room L39, Huntington, WV 25701. The ERR is accessible on weekdays from 8:30 A.M to 4:00 P.M. PUBLIC COMMENTS The Office of Development & Planning, located at 800 5th Avenue, Room L39, Huntington, WV 25701, welcomes written comments on the ERR from individuals, groups, or agencies. Please address any comments to the aforementioned office. The City of Huntington will carefully review all comments received by January 25th, 2024, prior to authorizing the submission of a request for the release of funds. When submitting comments, please indicate the specific notice that is being addressed. ENVIRONMENTAL CERTIFICATION In his capacity as Mayor, Steve Williams of the City of Huntington certifies to the U.S. Department of Housing & Urban Development that he consents to accept the jurisdiction of the Federal Courts in the event of any action brought to enforce responsibilities related to the environmental review process. It is further certified that all necessary responsibilities have been fulfilled. By approving this certification, the U.S. Department of Housing & Urban Development fulfills its obligations under NEPA and associated laws and authorities, thereby granting permission to the City of Huntington to utilize Program funds. OBJECTIONS TO RELEASE OF FUNDS The U.S. Department of Housing and Urban Development (HUD) allows objections to its release of funds and the City of Huntington’s certification within a fifteen-day period following the anticipated submission date or the actual receipt of the request (whichever is later). Objections will be considered if they are based on the following grounds: (a) the certification was not executed by the Certifying Officer of the City of Huntington; (b) the City of Huntington has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by U.S. Department of Housing and Urban Development; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
