NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned Joel P. Jones, Jr., Substitute Trustee by Notice of Substitution of Trustee, which notice is of record in the Office of the Clerk of the County of Commission of Cabell County, West Virginia, and by Deed of Trust dated 26 March 2014 executed by B and B Enterprises of WV, LLC to J. Grant McGuire and J. Patrick Jones, Trustees, which deed of trust is of record in the Office of the Clerk of Cabell County, West Virginia, in Trust Deed Book 2526 at Page 613, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee, with the assistance of Joe R. Pyle Auction & Real Estate Services, will sell the real estate described in the Deed of Trust, at a public auction on 16 April 2024 at 1:00 p.m. (1300) EST to the highest bidder at the east front door of the Courthouse of said County of Cabell, in Huntington, West Virginia, which real estate is more completely described as follows: First Tract: The following described real estate, situated in the Town of Culloden, Grant District, Cabell County, West Virginia, and known as a part of Lot Number “A”, conveyed by John Hager and Minnie Hager, his wife, to G. B. Meadows, being on the south side of the Chesapeake and Ohio Railroad Grade (now abandoned), being the east end of said Lot “A”; BEGINNING at Spring Branch, running West 90 feet with line of First Avenue; thence, south One Hundred and Fifty (150) feet to a stake; thence, southwest twenty six (26) feet to an alley; thence, east Sixteen (16) feet to a corner of Lot “‘B”; thence, with the line of Lot “B” northeast One Hundred and Forty (140) feet to the said Spring Branch; thence, with the meanderings of Spring Branch, to the BEGINNING, containing one-fourth (ONE-QUARTER) of an acre, more or less. Second Tract: All that certain piece or parcel of real estate, situate in Culloden, Grant District, Cabell County, West Virginia, and being the same piece or parcel of real estate that was conveyed to Rachel Sunderland by Hollis Braley and wife on the 17th day of January, 1910, as appears of record in Deed Book No. 106, at page 52, in the County Clerk’s office of Cabell County, West Virginia, to which Deed Book and Page reference is here made for a further description of the said real estate, it being the west end of Lot ”A,” and all of Lot Number one (1); BEGINNING at a post in line of First Avenue ninety (90) feet west of Spring Dale Branch; thence, south one hundred and fifty (150) feet to a stake; thence, south west 26 feet to a line of an alley; thence, west with said alley to a post a corner of Lot Number Two (2), thence, north with line of Lot Number Two (2), one hundred sixty (160) feet to line of First Avenue, thence, with said Avenue east to place of beginning, containing one (1) Acre, more or less. Third Tract: All that certain piece or parcel of real estate, situate in Culloden, Grant District, Cabell County, West Virginia, being part of the property as shown as right of way for First Avenue, Town of Culloden, Cabell County Clerk’s Office at Map Book I, Page 74, described as follows: Beginning at a concrete marker, being the northwesterly corner of Lot #1, Town of Culloden, thence N. 0DEGREES 45′ W. 39.1 feet to a point in the southerly right of way line of U.S. Route 60, further described as Station Number 71 plus 27.5, thence with said right of way N. 89DEGREES 15′ E. 102.5 feet to a concrete marker, thence with said right of way S. 83DEGREES 00’ E. 188.2 feet to a concrete marker further described as Station Number 68 plus 40, thence 26 feet plus or minus to a point in Spring Branch, thence with the northerly boundary line of Lot A and Lot 1. Town of Culloden, 310 feet more or less, to the point of beginning. EXCEPTING, however, from the foregoing tracts all that certain lot described as Tract “‘B”, situate in Grant District, Cabell County, West Virginia, described as follows. BEGINNING at a set 51/3″ pin on corner of Tracts A & B and on the right-of-way of US Route 60; thence running with US Route 60, N 87DEGREES 10’37” E 3.30 feet to a set 51/3″ pin; thence running, S 85DEGREES 04’ 23″ E. 188.21 feet to a found pipe; thence, S 59DEGREES 40’38” E 25.09 feet to a found pipe on line of lot one of White Oak Subdivision; thence running with Lot One and containing on line of Lot Two of White Oak Subdivision, S. 26DEGREES 36’08” E 128.94 feet to a found monument on corner of Tract B, corner of Lot Two of White Oak Subdivision and corner of Pifer Properties, LLC; thence running with Pifer Properties, LLC, S 64DEGREES 47’37” W 110.30 feet to a found pipe on the right-of-way of Marshall Lane and on line of Pifer Properties, LLC; thence running with Marshall Lane, S 87DEGREES 10’37” W 160.90 feet to a set 51/3′” pin on corner of tracts A & B ; thence leaving Marshall Lane and running with Tract A, N 02DEGREES 47’33” W 199.10 feet to the BEGINNING containing 0.97 ac., more or less, and as surveyed by Jimmy D. Calhoun, P.E. 4782, P.S. 1011, a copy of which Map is attached hereto and incorporated herein. TERMS OF SALE 1. The successful bidder (“Purchaser”) shall pay a ten percent (10%) nonrefundable down payment payable to the Trustee at the conclusion of the auction with the balance due and payable within forty-five (45) days from the date of the sale, payable by certified check, cashier’s check, or wired funds. In addition to the sales price, the Purchaser will be responsible for and shall pay a ten percent (10%) “Buyer’s Premium” which will be added to the final bid amount and shall be due at the time of sale payable to Joe Pyle Auction & Real Estate Services to determine the final aggregate contract price. Remote or online bidding may also be permitted at the discretion of the Trustee. Please contact the auction company in advance of the sale to arrange for remote bidding. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, right of ways and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
