NOTICE OF TRUSTEE’S SALE Under authority of that certain Deed of Trust dated December 6, 2022 from Ricky Van Mabry, Jr. and Kerrie Leanne Mabry to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Cabell County, West Virginia in Trust Deed Book No. 2911, at page 37, securing a promissory note in the principal amount of $76,833.98, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Cabell County Courthouse in Huntington, West Virginia, on April 23, 2024 at 8:30 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, all that certain lot or parcel of real estate, together with any and all improvements thereon, located and situated on Mud River in Grant District, Cabell County, West Virginia, and being more particularly described as follows, to-wit: Beginning at the common corner of Lot 4, Lot 5 and center of the right of way for Misty Valley Road, thence continuing with the common line of Lot 5, S 4DEGREES 48′ 26″ W, 10.55 feet to an iron pin (found), said pin being at the edge of the right of way for Misty Valley Road, thence S 1DEGREES 38′ 35″ E, 100. 48 feet with the common line of Lot 5, to an iron pin (found), said pin being a common corner with Napier, thence leaving the common line of Lot 5 and continuing with the line of Napier S 10DEGREES 21′ 06″ W, 78.21 feet to an iron pin (found) thence continuing S 62DEGREES 44′ 30″ W, 98.43 feet to an iron pin (found), thence continuing S 61DEGREES 41′ 36″ W, 99.73 feet to an iron pin (found); thence continuing S 53DEGREES 40′ 28″ W, 62.51 feet to an iron pin (found), said pin being a common corner with Lot 7, thence with the common line of Lot 7, N 8DEGREES 34′ 49″ W, 138.11 feet to an iron pin (found); thence continuing N 6DEGREES 11′ 05″ W, 89.86 feet to an iron pin (found), thence continuing N. 6DEGREES 40′ 09″ W, 96.92 feet to an iron pin (found), said pin being at the edge of the right of way for Misty Valley Road, thence continuing N 7DEGREES 16′ 14″ W, 13.26 feet to a point in the center of the right of way line for Misty Valley Road, said point being a common corner with Lots 3, 4 and 7, thence continuing with the center of the right of way for Misty Valley Road and Lot 4, N 87DEGREES 17′ 44″ E, 104.19 feet to a point; thence continuing with Lot 4 and the center of the right of way for Misty Valley Road S 82DEGREES 36′ 27″ E, 178.36 feet to the point of Beginning, and containing 1.58 acres, more or less. Said parcel being subject to the right of way for Misty Valley Road and as shown on the Corrective Map Showing Settlement and Agreement of Lands owned by Deloris Napier dated 15 March 1989 and recorded in Map Book 10, at Page 122. Together with a 2019 Manufactured Home, Serial No. CWP041244TN. Being the same property conveyed from Vanderbilt Mortgage and Finance, Inc. to Ricky Van Mabry, Jr. and Kerrie Leanne Mabry by Deed dated December 2, 2022, of record in the aforesaid Clerk’s office in Deed Book No. 2911, at page 34.
