NOTICE OF SUBSTITUTE TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by Deed of Trust dated February 23, 2019, by ELIZABETH A. LONG and JOHN A. LONG, wife and husband to DRU A. SHOPE, Trustee which said Deed of Trust was recorded in the Office of the Clerk of the County Commission of Cabell County WV, in Trust Deed Book 2607at Page at Pages 124. Said Trustee was substituted for DRU A. SHOPE by that Certain Notice of Substitution of Trustee recorded in said Clerk’s Office Book 417 at Page 494 and the BRIAN P CONATY, Substitute Trustee, having been requested so to do in writing by the Secured Creditor, and defaults having been made under the terms and conditions of said Deed Of Trust, and the provisions in said Deed of Trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Substitute Trustee will sell at public auction at: 2:00 o’clock p.m. on TUESDAY, the 23RD day of APRIL 2024. At the front door of the Courthouse in CABELL COUNTY, WV the following described real estate to wit: All that certain lot, piece and parcel of land located and situated in the City of Huntington, Cabell. County, West Virginia, known and designated upon a revised map of said City of Huntington, made by L. W. Leete. Civil Engineer, which map was filed in the Cabell County Court Clerk’s Office on December 31st, 1903, as a cross sectional portion of Lot Number 7, and the east half of Lot Number 6, in Block Number 108 and being more particularly described as follows: BEGINNING AT A POINT in the west line of Tenth Street. 75 feet in a southerly direction from the intersection of the south line, of Eleventh Avenue and said West line of Tenth Street, thence in a westerly direction and parallel with the south line of Eleventh Avenue, 90 feet to a point; thence in a southerly direction and parallel with said west line of Tenth Street, 31-ONE-QUARTER feet to a point; thence in an easterly direction, and parallel with the south line of Eleventh Avenue, 90 feet to a point in the west line of Tenth Street; thence in a northerly direction, and with said west line of Tenth Street, 31-ONE-QUARTER feet to the point of beginning, and being a lot 31-ONE-QUARTER feet by 90 feet, on the west side of Tenth Street, and known as house number 1107-Tenth Street. It is the intention of this Notice to Sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid Deed of Trust. The above-described property is reported as having a mailing address of 1107 10TH STREET, HUNTINGTON WV 25701 TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Substitute Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel or postpone the sale. No purchaser should take possession of or make improvements to the premises until the Trustee Deed is delivered. A Third-Party Purchaser at the sale will be required to pay the purchase price plus all recording and transfer fees. Trustee at the sale is under no duty to cause any existing tenant or persons occupying the subject property to vacate said property. FEDERAL TAX LIEN: In the event that there a Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local las, whichever is longer. The party(ies) secured by the Deed of trust reserves the right to purchase the property at such sale. If the purchaser at the sale is unable to complete the terms of purchase within 30 days, the trustee reserves the right to transfer the property to the next highest bidder. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or any posting of a notice of same, Should the Trustee not appear at the time and place of the appointed for the sale and there is no notice posted of a continuance please contact the Trustee to make further inquiry.
