NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of the authority under that certain deed of trust executed by Stacey M. McDaniel, to Susan L. Petrella and David G. Hammond, Trustees dated January 23, 2002, and recorded in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 2795, at page 710, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated February 20, 2024, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on May 22, 2024 at 5:45 p.m., at the front door of the courthouse of Kanawha County, West Virginia, the real estate conveyed by said deed of trust and situate in Elk District, Kanawha County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was 151 Cemetery Hill, Elkview, WV 25071 and being more particularly bounded and described therein as follows: All that certain tract or parcel of land, situate in Elk District, Kanawha County, West Virginia, being all of Lots 87 through 91 of the Durham Home Addition, and being more particularly described as follows: Beginning at the northwesterly intersection of Cemetery Hill Road and “B” Street at the southeasterly corner to Lot 89; thence S. 76-28-18 W. 128.06 feet, running with the northerly right-of-way of Cemetery Hill Road to a ONE-HALF inch rebar set; thence N. 17-16-00 E. 189.95 feet, leaving said right-of-way and running with the westerly lot Lines of Lots 91, 88, and 87 to a 1 inch pipe found at the common corner to Lots 87 and 86; thence S. 72-44-00 E. 110.00 feet, running with the common line of Lots 87 and 86 to a ONE-HALF inch rebar set in the westerly right-of-way of “B” Street; thence S. 17-16-00 W. 124.69 feet, leaving lot 86 and running with the westerly right-of-way of “B” Street to a railroad spike set at the point of beginning, as shown on that certain plat titled “Showing Lots 87, 88, 89, 90, and 91 of the Durham Home Place 151 Cemetery Hill Road, Elkview, West Virginia For: Stacey M. And being the same property conveyed to Stacey M. McDaniel, unmarried, by Deed from Helen Kay Moore, et al., said Deed being dated January 14, 2002, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 2542, at page 444. This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate. The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale.
