NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Date of Publication: May 8, 2024 Clay County Commission 246 Main Street Clay, WV 25043 304-587-4259 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Clay County Commission. REQUEST FOR RELEASE OF FUNDS On or after May 24, 2024 the Clay County Commission will submit a request to the West Virginia Department of Economic Development for the release of Community Development Block Grant (CDBG) funds under Title 1 of the Housing and Community Development Act of 1974, as amended, to undertake the following project: Project Title: Big Otter ebo alker Road Water Extension Purpose: To extend potable water to over 80 residences, businesses, and churches along Route 16. Location: The project is located entirely in Clay County. It begins at the 1-79 Interchange at the Exxon Station (last water connection of the District) and travels north along Route 16 to the Calhoun County Line and includes Big Otter, Nebo and Walker Road. Estimated Cost: $1,728,005.00 HUD $2,964,995.00 ARC Grant $ 975,000.00 WV IJDC District 2 Grant FINDING OF NO SIGNIFICANT IMPACT The Clay County Commission has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Clay County Commission, 246 Main Street, Clay, WV 25043 and the Regional Intergovernmental Council, 315 D Street, South Charleston, WV 25303 and may be examined or copied weekdays 9:00 A.M to 4:00 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Clay County Commission, 246 Main Street, Clay, WV 25043. All comments received by May 23, 2024 will be considered by the Clay County Commission prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. RELEASE OF FUNDS The Clay County Commission certifies to the West Virginia Department of Economic Development that the Honorable Joyce Johnson in her capacity as President, Clay County Commission consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. West Virginia Department of Economic Development’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Clay County Commission to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS West Virginia Department of Economic Development will accept objections to its release of fund and the Clay County Commission’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Clay County Commission; (b) the Clay County Commission has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the West Virginia Department of Economic Development; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the West Virginia Department of Economic Development at 1900 Kanawha Boulevard East, Building 3, Suite 700, Charleston, WV 25305. Potential objectors should contact the West Virginia Department of Economic Development to verify the actual last day of the objection period.
