NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated September 1, 2006, executed by Borrower, Monk X Ivanhoff, to Brian Carr, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3392, at Page 333. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 851 Watts St, Charleston, WV 25302. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 25, 2019, of record in the Clerk’s Office in Book 4397, Page 441. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 10th day of February, 2020 at 10:45 a.m. All that certain lot or parcel of land, containing 0.1585 acres, situate at 851 Watts Street, Charleston West Tax District (Assessor Map 15, Parcel 88), Charleston, Kanawha County, West Virginia, being all of Lot A as shown on the map entitled “MAP SHOWING PROPERTY SURVEYED FOR ROBERT S. CONKER, CHARLESTON WEST, KANAWHA COUNTY, SCALE: IN = 20 FT., DATED NOVEMBER 12, 1985, BY KING ENGINEERING & LAND SURVEYING CO.”, a copy of which is recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia; together with all improvements and appurtenances, being more particularly described as follows: Beginning at a point S. 39 50` W., 140.00 feet from the intersection of the northwesterly line of Watts Street and the southwesterly line of Patterson Street, thence S. 50 10` E., 162.59 feet; thence N. 39 50` E., 43.75 feet; thence N. 50 10` W., 132.62 feet; thence N. 39 38` 39″ E., 30 feet; thence S. 48 52` 44″ E., 30 feet; thence N. 39 50` E., 37.15 feet to the beginning, as shown on the map entitled “MAP SHOWING PROPERTY SURVEYED FOR ROBERT S. CONKER, CHARLESTON WEST, KANAWHA COUNTY, SCALE: IN = 20 FT., DATED NOVEMBER 12, 1985, BY KING ENGINEERING & LAND SURVEYING CO. This conveyance is expressly made subject to the following: 1) Customary easements of record or visible on the ground. 2) Reasonable reservations, exceptions and restrictive covenants or record. 3) All matters ascertainable by physical inspection, inquiry of parties in possession or an accurate survey after November 12, 1985. 4) Water line easement as shown on the map entitled, “MAP SHOWING PROPERTY SURVEYED FOR ROBERT S. CONKER, CHARLESTON WEST, KANAWHA COUNTY, SCALE: IN = 20 FT., DATED NOVEMBER 12, 1985, BY KING ENGINEERING & LAND SURVEYING CO.” 5) The effect of the terms of the agreement dated August 1, 1939, between Edith S. Conker and S. C. Conker, as grantors, and Edward W. Conker, as grantee, recorded on November 20, 1939, in the Clerk’s Office in Deed Book 518, Page 93. The agreement grants to Edward W. Conker an easement or right of way for the purpose of ingress and egress and for the purpose of maintaining a sewer and water line over the subject property. 6) Easement or right of way for the purpose of the construction and maintenance of a sewer in the Deed dated March 5, 1935, from Octave B. Conker, in the Clerk’s Office in Deed Book 401, Page 235. Being the same property conveyed to Monk Ivanhoff by the Deed dated September 1, 2006 and recorded in Deed Book 2669 at Page 131 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
